IN SECTION 3.16 OF THE ZONING CODE ORDINANCE 79-15

and desist or, in an appropriate case, that
corrective action be taken within a reasonable
time. The order of the building official shall
be final unless, within 14 days from the date of
the order, the person to whom the order is
issued files a petition for review with the
Hearing Examiner, who shall conduct a hearing
and issue an order in the matter. The Hearing
Examiner's order shall be final unless within
30 days from the date of the Hearing Examiner's
order an appeal is taken to Kitsap County
Superior Court.
(c)
A violation of any of the provisions of this
ordinance shall be deemed a misdemeanor and a
public nuisance. Once a violation of this
ordinance is found to exist by final order of
the building official or Hearing Examiner, the
City may enforce the ordinance through civil or
criminal proceedings or both. In the event
criminal proceedings are instituted against a
violator, the maximum penalty upon conviction
shall be a fine of $500.00 or imprisonment for
not more than six months or both such fine and
imprisonment. Each separate day the violation
continues shall be deemed a separate offense.
If civil proceedings are commenced to stop a
violation of this ordinance, such proceedings
may be commenced in either the Municipal Court
or the Kitsap County Superior Court.
(d)
All permits issued pursuant to the provisions
of this ordinance may be revoked and declared
invalid after completion of the following
procedures. Notice of violation of the provisions
of this ordinance shall be sent by certified
United States mail to the owner of record or
lessee of the property found by the building
official to be in violation of this ordinance.
If the violation has not been remedied within
30 days of notification of the violation, the
building official shall file a petition for
revocation of the appropriate permit. The
Hearing Examiner shall issue an order revoking
the permit where a violation of this ordinance
is found to exist.
