A~ ORDINANCE AMENDING ORDINANCE NO. 81-17
WATERCRAFT IMPOUNDMENT
WHEREAS Ordinance 81-17 provides for judicial
foreclosure as the sole means of foreclosing a lien
on impounded watercraft and,
WHEREAS there may be occasions when the value of
impounded watercraft is so small that the proceeds Co
be gained by foreclosure are insufficient to justify
the expense of initiating court action and,
WHEREAS Washington law provides a non-judicial means
of foreclosing liens on personal Property through summary
sale,
NOW THEREFORE, The City Council of the City of Winslow
DO ORDAIN as follows:
Section 6 of Ordinance 81-17 shall be amended to read
as follows:
SECTION 6. LIEN UPON VESSEL OR WATERCRAFT:
The impoundment of any vessel or watercraft pursuant to
the provisions of this ordinance shall create a lien against
such vessel or watercraft for all costs of impoundment,
removal and storage.
When the vessel or watercraft impounded has a market
value of three thousand dollars ($3,000.00) or more, the
lien shall be foreclosed through a civil action as provided
in RCW 61.12.162.

When the vessel or watercraft has a market value of
less than three thousand dollars ($3,000.00) the lien
may be foreclosed through the summary sale provisions of
RCW 60.10.010 - .070. The costs of foreclosure, including
reasonable attorney's fees, shall be payable out of the
proceeds of the sale of the vessel or watercraft.
