ORD 82-35 GENERAL PENALTY LANGUAGE ORDINANCEORDINANCE 82-35
AN ORDINANCE AMENDING ORDINANCE 82-06, PROVIDING
FOR A GENERAL PENALTY LANGUAGE ORDINANCE.
WHEREAS, State law at RCW 9A.04.040 defines a misdemeanor
as a crime for which the punishment d~es not exceed 90 days
imprisonment; and
WHEREAS, Winslow Ordinance 82-06, which was adopted as part
of the Book Publishing Company codification project,
appears to conflict with state law in that it establishes
for misdemeanors a punishment of 6 months imprisonment;
NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF WINSLOW DO ORDAIN AS FOLLOWS:
Section 1.
Section 1 of Ordinance 82-06 is hereby amended to read
as follows:
A. Except in cases where a different punishment
is prescribed by any Ordinance of the City of Winslow, any
person violating any of the provisions or failing to comply
with any of the mandatory requirements of any Ordinance of
the C~ty of Winslow, shall be punished by a fine not to
exceed Five Hundred Dollars ($500.00) or by imprisonment
not to exceed six months or by both such fine and imprisonment.
Section 2. Severability Clause.
Should any provision of this Ordinance be held invalid,
the remaining provisions shall continue in full force and
effect.
Section 3. Effective Date
This Ordinance shall be in full force and effect five
(5) days after posting in the manner provided by law.
PASSED by the CITY COUNCIL of the City of Winslow and
approved by the mayor on this second day of
December, 1982.
