Resolution No. 2022-02 Rescinding Prior Decision to Surplus Certain City Owned Real Property - Approved 022222Page 1 of 3 RESOLUTION NO. 2022-02 A RESOLUTION of the City Council of Bainbridge Island, Washington, repealing Resolution No. 2010-24 and rescinding a prior decision of the City Council that declared surplus certain City-owned shares in the Islander Mobile Home Park. WHEREAS, in 2004, the City purchased seven shares in the Islander Mobile Home Park Association, located in downtown Winslow, just north of City Hall, for affordable and income qualified housing purposes; and WHEREAS, on August 25, 2010, the City Council adopted Resolution No. 2010- 24, declaring the City’s seven shares to be surplus to the needs of the City and authorizing the sale of the shares, but only as current residents chose to vacate and the shares became available; and WHEREAS, the City currently retains two remaining shares, located at 227 and 301 Madrona Way, as shown in Exhibit A; and WHEREAS, since being declared surplus, the shares located at 227 and 301 Madrona Way have not been sold and remain City-owned real property; and WHEREAS, the City Council now desires to reconsider whether there are public uses for these properties, and wishes to rescind its prior decision declaring these properties to be surplus to the needs of the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. Resolution No. 2010-24 is hereby repealed in its entirety and the City Council hereby finds and declares that there are public uses for the remaining shares in the Islander Mobile Home Park located at 227 and 301 Madrona Way and, as such, those shares are no longer surplus to the needs of the City of Bainbridge Island. Section 2. Severability. If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect.
