AN ORDINANCE OF THE CITY OF WINSLOW AUTHORIZING
A PARTIAL REBATE OF SEWER UTILITY SERVICE
FEES TO CERTAIN CUSTOMERS OUTSIDE THE CITY
LIMITS, AND RATIFYING AND CONFIRMING PRIOR
ACTS

WHEREAS, in Ordinance 82-20 the City established
higher rates for utility service to customers located
outside the corporate limits of the City than for customers
located inside the City; and
WHEREAS, following review of the rates by the U.S.
Environmental Protection Agency and public discussion,
the City suspended the higher rates for service outside
the City; and
WHEREAS, the City established a new rate structure;
and until the new rate structure went into effect, a
portion of the sewer utility administrative costs had
been subsidized by the City's general tax revenues paid
by in-City customers; and
WHEREAS, customers outside the City should receive
a rebate for the higher rates they were billed minus
an amount equal to indirect administrative costs subsidized
by the City's general tax revenues which the City Council
finds to be $18.01 per customer; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF WINSLOW DO ORDAIN
AS FOLLOWS:
Section 1. The City Clerk/Treasurer is authorized
to pay a utility service fee rebate to the sewer utility
customers located outside the corporate limits of the
City of Winslow to whom the City billed the 50% surcharge
24. under Ordinance 82-20. The amount of the rebate shall
25[ be calculated and credited to the customers in accordance
26[ with this ordinance.
27i Section 2. The City Clerk/Treasurer shall calculate
28 the amount of rebate for each customer located outside
29 the City by calculating the total surcharge billed to
30] the customer minus $18.01.

Section 3. The amount of rebate shall be credited
to each customer's account with the City.
Section 4. All prior acts of officers and officials
of the City of Winslow, consistent with the provisions
of this ordinance, are ratified and confirmed.
Section 5. This ordinance shall take effect 5
days after its publication or posting as provided by
law.
