AN ORDINANCE OF THE CiTY OF WINSLOW, AMENDING
ORDINANCE NO. 78-07, AND ADDING NEW SECTIONS 6, 7, 8 and
9, REVISING SECTION 5 REQUIRING, IN CONNECTION WITH PERMITS
FOR CONSTRUCTION WORK AFFECTING CITY UTILITIES, REMOVAL OF
DIRT AND DEBRIS FROM STREET SURFACES, AND OTHER MUNICIPALLY
OWNED IMPROVEMENTS, AUTHORIZING THE ISSUANCE OF STOP WORK
ORDERS, AND REVISING PENALTIES FOR FAILURE TO COMPLY WITH
THE REQUIREMENTS OF THE ORDINANCE AS AMENDED.
WHEREAS, as a result of new construction and subdivision
development, considerable amounts of mud, dirt, rock and other
debris have been brought onto or otherwise deposited on the travel-
ed portions of public rights of way within the City of Winslow,
and
WHEREAS, such debris contributes to the degradation of water
quality, contributes to the potential clogging of storm sewer
systems, causes deterioration of road surfaces and is a potential
road hazard to motorists on the public roadways, and
WHEREAS, those persons responsible for depositing such debris
should be required to remove same, and
WHEREAS, the following amendment is in the best interest
of public health, safety and general welfare,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINSLOW,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. City of Winslow Ordinance 78-07 is amended by
revising Section 5 to read as follows:
§5 Violation - Penalty.
Violation of any of the terms of this ordinance may
be punished by imposition of a fine of not over $500 for
each offense, or not more than six months in jail for each
offense, or both, as determined by the Municipal Court.
Each day the violation occurs shall be a separate offense.

Section 2. City of Winslow Ordinance 78-07 is amended by
adding new sections 6, 7 and 8 as follows:
§6 Daily removal of deposits from rights of way and other
municipally owned improvements.
Any person, firm, or corporation making any deposits
of dirt, mud, rock, debris or other material of any nature
on the public rights of way and any other municipally owned
improvements shall clean up said deposits in a timely manner
during the course of and at the end of each day's operation.
Adequate equipment shall be available during each day of
operation. Adequate equipment shall be available during
each day of operation to ensure quick and timely removal
of any such deposits. The equipment available shall include
a power broom or other means approved by the City Engineer.
The rights of way surfaces and all catch basins, culverts
or other municipally owned improvements affected by the depos-
its shall be cleaned.
§7 Stop work order - Penalty for failure to comply.
In the event any person, firm or corporation fails to
comply with the provisions of §6, the City Engineer or his
designee may cause a Notice of Violation to be delivered
to a person of suitable age at the job site and may order
all work to cease until authorized by the City Engineer or
his designee to proceed. Work shall not resume until so
authorized by the City Engineer or his designee.
§8 Severability.
If any portion of this ordinance is for any reason held
to be invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality shall
not affect the validity or constitutionality of the remaining
portions of this ordinance.

Section 3. This ordinance shall be in full force and effect
5 days after publication as provided by law..
