ORD 84-06 PARKING WITHIN THE CITYORDINANCE ~O. 34-06 AN ORDI~]ANCE OF THE CITY OF WINSLOW, WASHING- TON, RELATING TO PARKING OF VEHICLES WITHIN THE CITY, AI~.~]ENDING ORDI~]Ai~CE NO. 82-12 AND ORDINANCE 83-04 TO PROVIDE FOR MONTIILY PARK- ING BY E~PLOYEES OF DOI~,~TO~ BUSINESSES. ~{EREAS, the problem of insufficient parking within the downtown business area of the City has been created in part by use of available parking spaces by employees of businesses located within the downtown area, and ~EREAS, enforcement of restrictions upon the length of permitted parking have proved difficult to achieve and has not been effective in reducing the amount of use of parking in the area by employees, and WHEREAS, the City Council has determined that a por- tion of the numbered parking stalls located on Brien and Bjune Drives should be set aside for use by employees of businesses within the downtown area in the effort to reduce the incidence of parking by such employees in the remainder of the downtown area, now, therefore, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That portion of Section V. a. of Ordinance No. 82-12, passed by the City Council on May 6, 1982 which pertains to parking in the numbered spaces located on Brien and Bjune Drives, as previously amended by Ordinance No. 83-04, passed by the City Council on March 3, 1983, is hereby further amended to read as follows: Fees and ttours Applicable to Parking in the Numbered Parking Spaces on Brien and Bjune Drives a. Spaces 300 - 316 : (1) 6:00 A.M. - 6:00 P.M., Monday - Saturday - during this period parking shall be limited to vehicles displaying a current, valid monthly business employee parking permit for this area issued by the City of Winslow. The permit must be displayed on the inside lower left hand corner of the windshield in such a manner that the monthly parking permit number is visible from the outside of the vehicle. (2) Permit Issuance/Fees - Upon receipt of a written application, permits designated "business employee permits" for such parking shall be issued to owners or operators of businesses located within the downtown business district of the City for use only by fulltime employees of such businesses while at work for the business. (3) Permits may be renewed on a monthly basis by in-person or telephone requests to the City Clerk. Revocation - If any permit issued pursuant to this Section is used by anyone other than a fulltime employee of a business located in the downtown area as provided in this Section, such permit shall be revoked by the City Clerk and any fee paid therefore shall be forfeited. Spaces 271 - 300, 317 - 324: (1) 6:00 A.M. to 9:00 A.M. - Limited to "Monthly" designated automobiles parking during these hours. Automobiles displaying current, valid monthly parking permits may park all day Monday through Fri.day:7 for the sum of $20.00 for each calendar month (~.ot to be pro-rated) Spaces 271 - 300, 317 - 324: (1) 9:00 A.M. - 6:00 P.M. - available to all automobiles. Section 2. This ordinance shall be in full force and in effect five (5) days after passage and publication by posting as provided by law. La, ,-ficK 6 IC uf/,7Sk«/ "Y f/4 , the legal description of which is set forth in Exhibit A of this agreement, attached hereto and incorporated by this reference as if set forth in full, which property is within the Central Business District of the City of Winslow, and WHEREAS, the Owner has remodeled, or does intend to remodel, an existing building on the property described in Exhibit A, and WHEREAS, the Owner wishes to take advantage of certain exemptions to the Winslow Zoning Code as provided in Ordinance No. 84-06 . NOW, THEREFORE, in consideration of approval of City permits for remodeling, including issuance of a building permit, and in evidence of mutual benefits, it is hereby agreed as follows : 1 . The Owner acknowledges that the subject property would be specially benefited by construction and installation of off-street parking spaces in the Central Business District, and agrees to participate in any Local Improvement District and/or Utility Local Improvement District which are formed in whole or in part, for the purpose of providing such off-street parking spaces in the Central Business District. The Owner waives the right to protest the formation of any such LID and/or Utility LID ; provided that Owner shall retain the right to contest the method of calculating the /assessment and the amount thereof and the boun- daries of any such district, to the extent other properties are not included. 2 . This Agreement shall be recorded with the Kitsap County Auditor and shall be a covenant running with the land described on Exhibit A, and shall be binding upon the Owners , the Owner' s successors in interest and assigns .
