ORD 84-24 REDUCING RATE OF ELECTRIC, GAS AND PHONE UTILITY TAXESPMA:jt 10/22/84 ORDINANCE NO. 84-24 AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON, AMENDING SECTION 5.08.040 OF THE WINSLOW MUNICIPAL CODE; ORDINANCE NO. 82-37, SECTION 1 PASSED BY THE CITY COUNCIL ON DECEMBER 2, 1982 AND ORDINANCE NO. 83-13, SECTION 1 PASSED BY THE CITY COUNCIL ON OCTOBER 20, 1983; REDUCING THE RATE AT WHICH ELEC- TRIC, NATURAL GAS AND TELEPHONE UTILITIES ARE TAXED AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Washington state legislature requires Section 4 of Chapter 49, 1st Extraordinary Session, Laws of 1982 and amended by Section 5 of Chapter 99, Laws of 1983 and Section 6 of Chapter 225, Laws of 1984, that the City of Winslow reduce the rate of tax imposed on electrical energy, natural gas, steam energy or telephone business from seven percent (7%) to six percent (6%) over a ten year period by one-tenth of the difference each year, and WHEREAS, 1985 will be the third year in such ten year period, and WHEREAS, the City Council finds that the' appropriate method for determining the amount of reduction of such tax rate to be by taking equal annual reductions of one-tenth of one percent (.1%), now, therefore, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN AS FOLLOWS: ; Section 1. Section 5.08.040 of the Winslow Municipal Code; Section 4(a) and (b) of Ordinance 81-38 passed by the City Council on December 17, 1981; Section 1 of Ordinance No. 82-37 passed by the City Council on December 2, 1982; Section 1 of Ordinance No. 83-13 passed by the City Council on October 20, 1983 are hereby amended to read as follows: Section 4. From and after the first utility bill rendered after January 1, 1985 there is hereby levied upon and there shall be collected from, every person, firm or corporation engaged in carrying on the following business for hire or for sale of a commodity or a service within or partly within the corporate limits of the City of Winslow the tax for the privilege of so doing business as hereinafter defined, to wit: (a) Upon any telephone business there shall be levied a tax equal to a percent of the total gross income, excluding income from intrastate toll, derived from the operation of such businesses within the City of Winslow as follows: Date Rate January 1, 1985 January 1, 1986 January 1, 1987 January 1, 1988 January 1, 1989 January 1, 1990 January 1, 1991 6.6% 6.5% 6.4% 6.3% 6.2% 6.1% 6.0% (b) Upon any business of selling or distribut- ing electric light or power, a tax to be equal to a percent of the total gross income derived from the operation of such business within the City of Winslow as follows: Date Rate January 1, 1985 January 1, 1986 January 1, 1987 January 1, 1988 January 1, 1989 January 1, 1990 January 1, 1991 6.6% 6.5% 6.4% 6.3% 6.2% 6.1% 6.0% (c) Upon any business selling, transmitting or distributing water, a tax to be equal to seven percent (7%) of the total gross income derived from the operation of business within the City of Winslow. (d) Upon any business providing sewer service, a tax to be equal to seven percent (7%) of the total gross income from the operatign of such business within the City of Winslow. Section 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or uncon- stitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. - 2 - Section 3. This ordinance shall be in full force and effect January 1, 1985.
