ORD 85-06 GRANT RELIEF TO DISABLED CITIZENSWDT: j t 2/19/85 ORDINANCE NO. 85-06 AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON, AMENDING ORDINANCE NO. 82-20 TO GRANT RELIEF TO QUALIFIED DISABLED CITIZENS FROM THE CITY'S UTILITY CHARGES; SPECIFYING THE CRITERIA FOR ELIGIBILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council finds that certain disabled persons have difficulty paying the increased costs of utility services, now, therefore, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Discount Granted. There is hereby granted to disabled citizens who meet the qualifications set forth in this ordinance, a twenty percent (20%) discount on the monthly utility charges of the City. Section 2. Application. In order to qualify for the discount, a person must file an application with the clerk/treasurer prior to January 1 of the year for which the discount is desired; provided, however, that for the year in which this ordinance is effective, applications may be made within sixty days of the effective date of this ordinance for discounts for the remainder of the year. Customers qualifying for the discount after the first of the year may apply at any time at least thirty days prior to the billing date upon which the discount is to be effective. Applicants must meet the requirements for eligibility set forth in Section 3 of this ordinance. Section 3. Requirements for Eligibility. A. The person claiming the discount must occupy the dwelling unit as a principal place of residence. B. The person claiming the discount must be the head of the household for the dwelling unit. C. The utility account must be in the name of the person claiming the discount. Persons living in multi-family residences where one water meter is used for the entire building shall not be eligible even if all other requirements are met. D. No person may claim a discount for more than one dwelling unit during the same billing period. E. For the purposes of this ordinance a disabled person is one who is disabled as defined by the Social Security Administra- tion and who receives social security benefits for that disabi- lity or any other benefits for that disability from any other governmental or non-governmental source. F. The person applying must have total yearly disposable income, including that of his or her spouse or co-tenant of $10,000 or less. G. The discount granted by this ordinance shall not be used in conjunction with the low income elderly discount authorized by Ordinance No. 82-32, passed by the City Council on October 21, 1982. Section 4. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law.
