ORDINANCE NO. 86-01
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON,
ADDING A NEW SECTION 12.28.025 TO THE WINSLOW
MUNICIPAL CODE AUTHORIZING DEFERRAL OF CONSTRUC-
TION OF SIDEWALKS UNDER CERTAIN CONDITIONS; AND
AMENDING SECTION 12.28.030 TO REQUIRE PAVEMENT OF
ANY AREA BETWEEN NEWLY CONSTRUCTED CURBS AND
ABUTTING PAVEMENT BY THE DEVELOPER OR ABUTTING
PROPERTY OWNER.
WHEREAS, the City Council finds that the following
amendments will promote the orderly construction of sidewalks in
the City, now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. A new Section 12.28.025 is hereby added to
the Winslow Municipal Code to read as follows:
12.28.025 Deferral of Construction Authorized.
Installation of any of the improvements herein
required may be deferred if the Land Use Adminis-
trator determines that the abutting street grade
cannot be established at the time of proposed
construction or that existing curb and sidewalks
are adequate to serve the development in question.
In either case the owner of the abutting property
shall execute a covenant in a form approved by the
City which runs with the land being developed and
which provides for installation of sidewalks and
other street improvement at a specified later
date. The covenant shall provide that the
improvements shall be installed to City standards
when any one of the following first occurs:
1) The grade of the abutting
established;
street is
2) The abutting street is improved through an
LID, ULID, or other funding method;
Similar improvements
adjacent property; or
are constructed on
When existing sidewalks and/or curbs are
inadequate in the opinion of the City.
Section 2. Section 12.28.030 is hereby amended to
read as follows:
12.28.050 Construction Standards. Construction
standards for sidewalks shall be the same as
required for subdivisions and short subdivisions.
In addition, the developer or abutting owner shall
pave to City standards and specifications any
unpaved portion of the rlght of way between the
newly constructed curb and the existing road
pavement.
Section 5. This ordinance or a summary thereof shall
be published in the official newspaper of the City, and shall
take effect and be in full force five (5) days after the date of
publication.
