ORDINANCE NO. 86-04
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON,
ADDING A NEW SECTION 10.18.030 TO THE WINSLOW
MUNICIPAL CODE PROHIBITING THE NEGLIGENT OPERATION
OF SKATEBOARDS AND ESTABLISHING A PENALTY FOR
VIOLATIONS.
WHEREAS, the Winslow City Council finds that the
regulation of skateboards upon roadways, sidewalks and publicly
owned parking lots is necessary to promote the public health,
safety and welfare, now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Sectlon 1. There is hereby added to the Winslow
Municipal Code a new Sectlon 10.18.030 to read as follows:
10.18.030 Negligent Operation of Skateboards
Prohibited - Penalty.
A. Prohibition. It is unlawful for any person to
operate a skateboard in a negligent manner upon
any roadway, sidewalk or publicly owned parklng
lot. For the purpose of this section, "to operate
in a negligent manner" means the operation of a
skateboard in such a manner as to endanger or be
likely to endanger any persons or property.
B. Any person violating any provision of this section
shall be guilty of a civil infraction, and upon
conviction thereof, shall be punished by the
imposition of a monetary penalty of not more than
Two Hundred Fifty Dollars ($250.00). Community
service hours may be imposed in addition to or in
lieu of a monetary penalty.
Section 2. If any section, sentence, clause or phrase
of this ordinance should be held to be lnvalid or unconstitu-
tional by a court of competent jurisdiction, such invalldity or
unconstitutionality shall not affect the validity or constitu-
tionality of any other section, sentence, clause or phrase of
this ordinance.
Section 5. This ordinance or a summary thereof which
includes the penalty provision shall be published in the offlcial
newspaper of the City, and shall take effect and be in full force
five (5) days after the date of publication.
