AN ORDINANCE PROVIDING FOR THE CONDEMNATION OF
A PORTION OF LANDS OF JAMES G. AND JANE DOE
PELLAND, TAX LOT # 272502-4-009-2007 AT 563
MADISON AVENUE NORTH, AND FOR MAKING CERTAIN
ASSESSMENTS FOR MADISON AVENUE LID IMPROVEMENTS
THEREON AND ADJACENT THERETO.
WHEREAS, the City of Winslow finds it in the public
interest and for public use to condemn certain property owned
by James G. and Jane Doe Pelland~ Tax Lot #272502-4-009-2007,
located at 563 Madison Avenue North, Winslow~ Washington, and
WHEREAS, the condemnation is for making certain
assessments for Madison Avenue LID, and
WHEREAS~ the taking is for acquiring a portion of
the above property in order to make certain improvements under
the Madison Avenue LID project, now therefore,
The City Council For the City of Winslow, Washington
do ordain as follows:
Section 1. A condemnation lawsuit is herewith
authorized against James G. and Jane Doe Pelland, pursuant to
certain specific improvements provided for under the Madison
Avenue LID previously approved by ordinance, to obtain a portion
of their land and charge them as owners with certain LID assess-
ments, located at 563 Madison Avenue North, Winslow, Wa.~ also
known as Tax Lot #272502-4-009-2007.
Section 2o Such improvements shall be paid wholly
or in part by special assessment upon the property benefited.
The purpose of such special assessments shall be for the purpose
of streets, avenues~ alleys~ or highways, alterations thereof,
or changes of the grade therein, or other improvements in or
adjoining the same, or for bridges, approaches, culverts,
sewers, drains, ditches, or in connection therewith.
Section 3. This ordinance shall be in full force and
take effect five days after passage and publication as provided
by law. However, such lawsuit is authorized to be commenced
forthwith, upon signature of the Mayor after approval by
council.
