AN ORDINANCE AMENDING THE ZONING
ORDINANCE OF THE CITY OF WINSLOW
IN ORDER TO PROVIDE FOR HAZARDOUS
WASTE TR,EATMENT AND STORAGE PURSUANT
TO RCW 70,105
WHEREAS, the City of Winslow, hereinafter referred to as the
"City", has submitted an application approval to the State
Department of Ecology of this ordinance to designate land use
zones for hazardous waste treatment and storage as a permitted
use, and
WHEREAS, the Winslow Planning Agency and/or the Winslow
Hearing Examiner, pursuant to normal processing have recommended
adoption of this ordinance, and
WHEREAS, certain conditions exist which require a draft of
this ordinance be submitted for review by the State Department of
Ecology by June 30, 1988, and
WHEREAS, the City Council at its regular meeting adopted
findings and conclusion, as follows:
NOW THEREFORE, the Mayor and City Council of the City of
Winslow, Washington, do ordain as follows:
Section 1. That Section 1 entitled Definitions of the City
zoning ordinances are herewith amended in all particulars in or-
der to comply with the provisions of RCW Chapter 70.105 so as to
provide for a definition of hazardous waste as set forth in RCW
Chapter 70,105.
Section 2. The Official Zoning Ordinance of the City of
Winslow, as adopted by Ordinance No. 87-30, passed by the City
Council on December 3, 1987, as amended is hereby further amended
by amending Sections X A through I and XI of the commercial and
industrial zones of the City to provide in the list of permitted
uses under each such zone for approval of any on-site treatment
and storage facility for hazardous wastes as defined herein,
provided that such facilities meet state siting criteria and
requirements as set forth in Chapter 70,105 of RCW.
Section 3. The Land Use Administrator is hereby instructed
to effectuate the necessary amendments as necessary to the Offi-
cial Zoning procedures and Map of the City of Winslow pursuant to
this ordinance.
Section 4. The Mayor is hereby authorized to execute and
the City Clerk to attest to this document, the legal description
of the property, and concomitant ~greement, as attached, with the
Kitsap County Auditor.
Section 5. This ordinance title shall be published in the
official newspaper of the City, and shall take effect and be in
full force five (5) days after the date of publication-
