ORD 89-04 PARK COMMISSIONERSORDINANCE NO. 89-04 AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON ESTABLISHING A BOARD OF PARK COMMISSIONERS; ESTABLISHING STAGGERED TERMS OF FOUR YEARS FOR MEMBERS; PROVIDE FOR REMOVALS; SETTING TIMES FOR MEETINGS AND ORGANIZATION; ESTABLISHING QUORUMS; AND ESTABLISHING POWERS, DUTIES, AND BUDGETS. The Mayor and City Council of the City of Winslow, Washington, do ordain changes to its code by adding the following: Section 1. 2.32.010 Definitions Words used in this chapter shall be defined as follows: A. "Board" means Board of Park Commissioners. B. "Park" means an area of land used for public recreational purposes, including landscaped tracts, picnic grounds, playgrounds, athletic fields, recreational centers, trails and pathways, mini- parks and all other recreational facilities for the use and benefit of the public, including municipal buildings in such facilities. 2.32.020 Composition-Appointments-Terms-Vacancies-Chairman Five park commissioners shall constitute the Board of Park Commissioners, three who shall serve without compensation, three of whom shall be residents of the city. Three commissioners shall be appointed by the Mayor, with the approval of the majority of all members of the city council, and shall serve for a term of four years each. The first members shall serve staggered terms of one, two, and three years respectively, to be determined by the Mayor at time of appointment. Each year in December, the Mayor shall, subject to council confirmation, appoint the successors of the commissioners whose terms expire. The other two commissioners shall consist of two Councilmembers who sit on the council standing committee on parks. Each year at their first meeting in January, the commissioners shall elect, from their members, a chairman, vice chairman and secretary, which officers shall have at least one year of remaining service. 2.32.030 Filling vacancy upon removal of commissioner The Mayor may, with the consent of the majority of all members of the City Council, remove without cause any -1- co~mnissioner. The vacancy thus created shall be filled by an appointment of the Mayor with the approval of a majority of all members of the City Council. A member thus appointed shall serve for the remainder of the unexpired term. This procedure shall also apply to any vacancies arising through the resignation of a member. 2.32.040 Meetings-Presiding Officer-Quorum A. The Board shall hold regular monthly meetings at a specified day and time as may be determined by a majority vote of the board members, and in addition may hold special meetings at such times as may be called by the chairman with written notice to each member at least 24 hours before the time for the proposed meeting. All meetings shall be conducted in accordance with Roberts Rules of Order, shall be open to the public and subject to the Open Public Meetings Act of the state, RCW 42.30. B. Meetings of tne board shall be presided over by the chairman if present, or by the vice chairman in the absence of the chairman. At all meetings of the board, a majority of three shall constitute a quorum for the transaction of business, and a majority vote of those present shall be necessary to pass any motion. The secretary shall keep accurate minutes of all meetings, the original of which shall be filed with the city clerk. Minutes shall be distributed to the members within two weeks following each meeting. C. The board shall publish at least one week in advance of all regular meetings and 24 hours in advance of any special meeting, a written agenda for that meeting. 2.32.050 Powers and duties A. The board is authorized to make rules necessary for the conduct of its business, which rules shall be public records and placed on file with the city clerk. B. The board shall be advisory to the City Council regarding the supervision and control of park and recreation facilities within the city. C. The board shall advise the City Council -2- regarding conduc~, of any form of recreation or cultural activity taking place in city park facilities; control and supervision of all city parks; planning, promotion, management, acquisition, construction, development, maintenance and operation, including restrictions on and compensation for use of park facilities. D. The board shall as necessary prepare a comprehensive park plan for the city, which when adopted by the City Council shall set forth the future park and recreation requirements of the city. E. The board shall manage and supervise the Waterfront Park Bandstand so as to maximize its use in ways that will. benefit the community. This function shall include: (1) Promotion of musical and theater events in ways that will attract local and out-of-town people into Winslow. (2) Acquisition and/or hiring of appropriate performers and performing groups. (3) Scheduling of all bandstand events. In performing these duties, the board shall seek performances which are in good taste, and which will appeal to a diverse segment of the community. T].e board shall periodically transmit its proposed schedule of performances to the Council standing committee on parks for approval by the Council. 2.32.060 Budget A. In support of the yearly budgeting process, the board shall submit to the City Council on or before the twentieth day of September, an estimate of the amount of money required to carry on its activities for the ensuing year, together with recommendations for the development of programs and facilities which it may deem beneficial. Section 2.
