ORD 89-21 TAKE-OUT FOODORDINANCE NO. 89-21
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON, AMENDING THE
WINSLOW ZONING ORDINANCE 87-30 AND DEFINING FORMULA TAKE-OUT
FOOD RESTAURANTS ELIMINATING FORMULA TAKE-OUT FOOD RESTAURANTS
AS PERMITTED USES IN THE CENTRAL BUSINESS DISTRICT, THE MADISON
AVENUE DISTRICT, THE NORTH CITY CENTER DISTRICT, THE LOWER
ERICKSEN DISTRICT, THE UPPER ERICKSEN DISTRICT, THE FERRY
TERMINAL DISTRICT, THE LOWER MADISON WATERFRONT DISTRICT AND
THE GATEWAY DISTRICT AND LIMITING FORMULA TAKE-OUT FOOD
RESTAURANTS TO CERTAIN PORTIONS OF THE HIGH SCHOOL ROAD
DISTRICT.
WHEREAS, the City Council of the City of Winslow, Washington,
has determined that the present zoning ordinance should be amended; and
WHEREAS, the City Council of the City of Winslow, Washington,
finds that the policies and actions outlined in the Land Use Subsection
of the Land Use Plan of the Comprehensive Plan require limitation of
formula take-out food restaurants, and certain zones; and
WHEREAS, The City Council of the City of Winslow, Washington,
finds that the Structural Concepts outlined in the Urban Design
subsection of the Land Use Plan of the Comprehensive Plan calls for
pedestrian orientation in areas within one-half (1/2) mile of the
ferry; and
WHEREAS, the City Council of the City of Winslow, Washington,
finds that the Strategic Plan of the City of Winslow calls for
maintaining the village character of the City of Winslow; and
WHEREAS, the City Council of the City of Winslow, Washington,
finds that formula take-out food restaurants are automobile rather than
pedestrian oriented businesses; and
WHEREAS, as the City Council of the City of Winslow, Washington,
finds that formula take-out food restaurants represent a type of
business that must be confined to portions of the automobile oriented
High School Road zone in order to protect the village character of the
City of Winslow; now, therefore,
THE MAYOR AND CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Winslow Ordinance No. 87-30, Exhibit B, Section 1,
Definitions, is [ereby amended to add the following definition:
Formula Take-out Food Restaurant means a restaurant required by
contractural or other arrangement to offer standardized menues,
ingredients, food preparation, interior or exterior design, or
uniforms; and serves its food in disposable containers.
Section 2. Winslow Ordinance No. 87-30, Exhibit B, Section
X-A, Central Busi'ness district zone, subsection X-A.2.A. of permitted
uses is hereby revised to read as follows:
A. Retail sales not requiring outdoor storage, except formula
take-out food restaurants.
Section 3. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", Section X-B, Madison Avenue District, subsection X.B.2.A.
of permitted uses is hereby revised to read as follows:
A. Retail sales not requiring outdoor storage, except formula
take-out food restaurants.
Section 4. Winslow Ordinance 87-30, Exhibit B, "Zoning
Ordinance", SectYon X-C, North City Center District, subsection X-C.A.
of permitted uses is hereby amended to read as follows:
A. Retail sales not requiring outdoor storage, except formula
take-out food restaurants.
Section 5. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", SectYon X-D, Lower Ericksen District, subsection X.D.2.A.
of permitted uses is hereby amended to read as follows:
A. Retail sales in structures with footprints smaller than
1,000 square feet, except gasoline filling stations, formula take-out
food restaurants, drive-in businesses, and businesses with outdoor
storage areas.
Section 6. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", Section X-E, Upper Ericksen District, subsection X-E.2.A.
of permitted uses is hereby amended to read as follows:
A. Retail sales in structures with footprints smaller than
1,000 square feet, except gasoline filling stations, formula take-out
food restaurants, drive-in businesses, and businesses with outdoor
storage areas:
Section 7. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", Section X-F, Ferry Terminal District, subsection X-F.2.B.1,
of permitted uses is hereby amended to read as follows:
B.1. Retail sales not requiring outdoor storage except
formula take-out food restaurants.
Section 8. Winslow Ordinance No. 87-30, Exhibit B, Section X-
G, High School R~ad District, subsection X-G.2.A, is hereby amended to
read as follows:
A. Retail sales not requiring outdoor storage. However,
formula take-out food restaurants shall only be permitted within 250
feet of the intersection of the edges of the right-of-way of High
School Road and SR 305.
Section 9. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", sectYon X-I, Lower Madison Waterfront District, subsection
X.I.2.A. of permitted uses is hereby amended to read as follows:
A. Retail sales not requiring outdoor storage except formula
take-out food restaurants.
Section 10. Winslow Ordinance No. 87-30, Exhibit B, "Zoning
Ordinance", sectio"n X-l, Gateway District, subsection X-I.2.A. is
hereby amended to read as follows:
A. Retail sales not requiring outdoor storage except formula
take-out food restaurants.
Section 11. This ordinance or a summary of the title shall be
published in the'gfficial newspaper of the City of Winslow, Washington,
and shall take effect and be in full force five (5) days after
publication.
