ORDINANCE NO. 89-41
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON,
AMENDING THE WINSLOW MUNICIPAL CODE, TITLE 18,
ENTITLED ZONING, TO REVISE CHAPTER 18.56, LOWER
ERICKSEN DISTRICT, ELIMINATING MULTI-FAMILY
RESIDENCES, LIMITING STRUCTURES OVER 25 FEET HIGH AND
DESIGNATING STRUCTURES OVER 25 FEET HIGH AND
TEMPORARY BUSINESSES AS CONDITIONAL USES; ELIMINATING
INDOOR ENTERTAINMENT AND AMUSEMENT AS A CONDITIONAL
USE; AND REQUIRING THE EXTERIOR OF NEW BUILDINGS TO
BE RESIDENTIAL IN CHARACTER AND SCALE.
WHEREAS, the City Council of the City of Winslow,
Washington, has determined that the Zoning Code should be
amended; and
WHEREAS, the Planning Agency conducted the required
public hearing on the 26th day of January, 1989; and
WHEREAS, the City Council of the City of Winslow,
Washington, finds that the policies outlined in the Land Use
subsection of the Comprehensive Plan require the updating of
the Zoning Code; now, therefore
THE MAYOR AND CITY COUNCIL OF THE CITY OF WINSLOW DO ORDAIN
AS FOLLOWS: .
Section 1. Chapter 18.56, entitled Lower Ericksen District,
is hereby amended in its entirety to read as follows:

Commercial Zone -- Lower ~ricksen District, Section
WMC 18.56.010 Purpose. ,
The purpose of the Commercial Zone -- Lower Ericksen
District, is to provide s~all scale commercial
services to the residents of the city and the
visiting public and to provide a high quality setting
for existing and new residences near the Central
Business District. The provisions herein are
intended to integrate community-oriented commercial
activities within a viable and stable residential
neighborhood. ~
WMC 18.56.020 Permitted Uses.
Permitted Uses shall be as follows:
A. Retail sales in structures with footprints
smaller than 1,000 square feet. Gasoline filling
stations, formula take-out food restaurants, drive-in
businesses and businesses with outdoor storage areas
are excluded;
B. Personal and professional services;
C. Bed and breakfast establishments;
D. Small appliance repair and similar uses;
E. Signs subject to the provisions of the sign
ordinance;

F. Public parks or playgrounds;
G. Planned unit developments;
H. Residences in accordance with the provisions
of Chapter 18.40, Planned Unit Developments;
I. Single-family residences in accordance with
Chapter 18.28, High Density (10,000 square feet)
Single Family Residential Zone;
J. Similar uses as determined by the building
official.
WMC 18.56.030 Conditional Uses.
Conditional uses shall be as follows:
A. Public and private utility buildings and
structures;
B. Structures over 25 feet in height that
demonstrate an articularLy creative design and do not
substantially reduce view opportunities from
adjoining properties;
C. Senior citizen housing projects utilizing
the bonus densities set forth in Section 18.20.080;
D. Educational, cultural, governmental,
religious or health care facilities;
E. Retail sales in structures with footprints
larger that 1,000 square feet;
F. Temporary businesses or structures;
G. Other uses deemed likely to cause a nuisance
if not otherwise controlled.
WMC 18.56.040 Minimum Lot Area.
There shall be no minimum lot area.
WMC 18.56.050 Lot Coverage.
A. The maximum lot area covered by buildings
shall not exceed thirty-five percent.
B. The maximum lot coverage of any single
building including porches and decks over three feet
above grade and attached garages shall be two
thousand square feet. If two or more structures
occupy the same lot, the structures shall be
separated by a strip of open land or lane at least
five feet in width.
WMC 18.56.060 Yards. :
A. Front rear and side yards shall not total
less than twenty-five feet. Side yards shall be at
least five feet. Front yards shall be at least
fifteen feet. ~
B. For properties east of Ericksen Avenue that
are within Hall Brothers Creek and Slough drainage,
all structures, parking areas and pavements except
for public pedestrian access trails and viewing
platforms shall be set back from the top of slope
into Hall Brothers Creek and slough a minimum of five
feet. The top of slope shall be defined as the point
where the slope into the creek drainage becomes at
least twenty percent (two feet vertical fall per ten
feet horizontal distance). No structure or pavements
in the area specified above except for public
pedestrian access trails and viewing platforms shall
be built in the Hall Brothers Creek and Slough
drainage on ground with an existing slope greater
than twenty percent.
WMC 18.56.070 Parking.'
A maximum of two parking spaces shall be allowed in a
front yard.
WMC 18.56.080 Building Requirements.
Exteriors of all new construction and alterations to
exteriors of existing structures shall be residential
in character and scale and flat roof structures shall
not be allowed.
Section 2. Severability. If any provision hereof is found
to be unenforceable, the remaining provisions shall
be in full force and effect.
Section 3. This ordinance or a summary of the title shall be
published in the official newspaper of the City of
Winslow, Washington and shall take effect 5 days
after publication and posting as required by law.
