AN ORDINANCE AMENDING ORDINANCE NO. 63-137,
SO AS TO PROVIDE FOR A CORRECTED LEGAL DES-
CRIPTION AS A RESULT OF MORE RECENT SURVEYS
REGARDING WING POINT GOLF AND COUNTRY CLUB.
WHEREAS, the City of Winslow has previously annexed
certain parcels of land which after more recent surveys have
had their legal descriptions corrected, and
WHEREAS, said annexation ordinances need now be
corrected only to reflect those more accurate metes and
bounds descriptions,
NOW, THEREFORE, Be It Ordained by the Mayor and
Council of the City of Winslow as follows:
Section 1. Ordinance No. 63-137 is herewith amended
to correct the metes and bounds descriptions therein so as to
read in accordance with Exhibit "A" hereto, incorporated
herein by reference as if fully set forth herein.
Section 2. The areas annexed hereby shall be
considered a pare of the City of Winslow on and as of the
date when said previous ordinances were adopted and placed in
effect.
Section 3. This ordinance shall take effect and be
in force five days from the date of publication hereof.

By Resolution 89-33, passed by the Winslow City Council, Wing
Point East was granted preliminary plat approval. One of the
conditions of this resolution was the requirement that ARONA
assume its pro rata share of assessments identified in Exhibit 1
of PUD zoning ordinance 79-16 (Wing Point Fairway View PUD).
Total costs relating to sidewalk development as described in
paragraph 2 and listed in Exhibit I of Ordinance 79-16 are
$27,170. A~RONA will pay to the City of Winslow at transfer of
title (from Fraser Development to ARONA Corporation) 42.8%
($11,628.76) of the $27,170 referenced above. Thereafter, Fraser
Development Corporation will be responsible for no more than
57.2% ($15,541.24) of the $27,170 referenQed above.
ARONA Corporation will also pay at the above-reference closing,
the same pro rata share (42,8%) of the' total unpaid balance of
the sewer assessment (in the original amount of $ -~O -- )
levied against Alan F. Black and/or Fraser Development
Corporation. Thereafter, Fraser Development and/or Alan Black
and :heir successors will be responsible for 57.2% of the total
unpaid balance of the sewer assessment. The total amount of the
sewer assessment will be determined by the City of Winslow.
It is also understood and agreed that Resolution 89-33 ~oes not
impose directly or indirectly, any new conditions or restrictions
or any time limit or other constraint upon the remaining portion
(Lots 1,2 and 4) of the Fraser PUD.
