ORD 89-46 NORTHWEST ENERGY CODEFor Consideration: 10-19-89 Revised: !1-30-89 ORDINANCE NO. 89-46 AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON, ADOPTING THE "NORTHWEST ENERGY CODE" TO THE WINSLOW MUNICIPAL CODE, ~MENDING THE "ENERGY CODE" OF THE CITY OF WINSLOW, AND AMENDING WINSLOW MUNICIPAL CODE ].5.04.020 (G). WHEREAS, the Northwest Power Planning and Conservation Act of 1980 mandated that conservation be given priority in plann~,g for acquisition of electrical energy resources; and WHEREAS, the Northwest Power Planning Council has responded to this mandate in development and adoption of the Northwest Conservation and Electric Power Plan by including the Energy Code in the Plan; and WHEREAS, the City Council finds that providing the Northwest Energy Code as the standard for use in the design and construction of new buildings and structures and additions and remodels no existing buildings and structures promotes the efficient use of electrical energy in the City; and WHEREAS, the City Council finds that the Bonneville Power Administration is prepared to provide funds to the city for the purposes of 1) reimbursing the consumers certain costs incurred in efforts to comply with the Northwest Energy Code; and 2) Providing training, technical assistance, and inspection costs to City officials for implementation of the Northwest Energy Code; and WHEREAS, the ~ity Council finds that the adoption and enforcement of the Northwest Energy Code for applicable electrically heated and/or conditioned buildings promotes the public health, safety and general welfare of the citizens of Winslow; now, therefore THE MAYOR AND CITY COUNCIL OF THE CITY OF WINSLOW DO ORDAIN AS FOLLOWS: Section 1: Winslow Municipal Code section 15.04.020 G., is hereby amended to read in its entirety as follows: G. The Washington State Energy Code Amended. (1) The most current ~a=tion of the Washington State Energy Code as promulgated by the State Building Code Council according to statute (WAC 51.12) shall set forth minimum requirements for the design and construction of new buildings and structures and additions and remodels to existing buildings and structures, subject to the zu~lowing qualifications; (2) From and after its effective date, as hereinafter provided, the Northwest Energy Code, June 1987, edition (specifically, the "Complete Code Version" and not the "Uniform Building Code Compatible Version"), as published by the Bonneville Power Administration, shall be in effect with respect to: (a) New residential construction using electrical space heating; and (b) New connnercial construction using electrical space conditioning and electric lighting. EXCEPTION: 1. Commercial building ventilation requirements contained in Section 305 of the Washington State Energy Code shall remain the applicable standard. EXCEPTION: 2. Commercial buildings which are not electrically space conditioned shall only be required to comply with Section 505 of said Northwest Energy Code (Electrical Power and Lighting). (c) All builon~gs constructed after the effective date of this ordinance that are subsequently converted to provide electrical space heating or conditioning, in part or in whole. (3) Notwithstanding the implementation of the Northwest Energy Code, the Washington State Energy Code shall continue to apply to all construction not otherwise covered by the Northwest Energy Code; provided, that Section 502.1.7.2 of the Northwest Energy Code shall apply to all low-rise Residential Occupancies regardless of fuel source. (4) The Northwest Energy Code shall not become effective until 30 days subsequent to the date that the City and the Bonneville Power Administration have executed a grant agreement providing for reimbursement to the owner or builder of new residential construction for those additional costs to the consumer of conservation components that are attributable to the implementation of the Northwest Energy Code and/or administrative enforcement costs associated with the adoption of the Northwest Energy Code that are over and above the costs of the Washington State Energy Code; provided, however, in no event shall the effective date be sooner than January 1, 1990. (5) Should reimbursement funds furnished by the Bonneville Power Administration and/or Puget Sound Power and Light Company, as oe~ribed above, be discontinued, or otherwise determined by the City Council to be inadequate to cover those incremental costs or maintain economic feasibility for the homeowner with implementation of the Northwest Energy Code, the City Council may repeal this ordinance. Section ~. Severability. If any provision hereof is found to be unenforceable, the remaining provisions sRal~ be in full force and effect. Section 3. This ordinance or a summary of the title shall be published in the official newspaper of the City of Winslow, Washington, and shall take effect 5 days after publication and posting as required by law.
