AN ORDINANCE OF THE- CITY OF WINSLOW, WASLiiNGTON, AMENDING
THE ZONING ORDINANCE, TITLE 18, OF 'tHE WINSLOW MUNICIPAL
CODE TO REGULATE AND DEFiNE~ DWELLING, SiNGLE-FAMILY,
DWELLING, MULTIFAMILY, SITE BUILT~ FACTORY' BUILT, KIT,
MANUFACTURED, MOBILE, MODULAR AND PANELIZED HOMES,
MANUFACTURED HOME DEVELOPMENT, MOBILE HOME PARK, AND
PERMANENT FOUNDATION-
PERMITTING SITE BUILT, FACTORY BUILT, KIT AND PANELIZED
HOMES WHEREVER SINGLE-FAMILY DWELLINGS ARE PERMITTED AND
PERMITTING MANUFACTURED HOMES ONLY IN MANUFACTURED HOME
DEVELOPMENTS IN NORTH CITY CENTER DISTRICT AND MULTIFAMILY
ZONES.
WHEREAS, the City Council of the City of Winslow,
Washington, supports the need for affordable housing; and
WHEREAS, the City Council of the City of Winslow, Washington
wishes to protect private property values that are inconsistent
with existing zoning uses; and
WHEREAS, the City Council of the City of Winslow, Washington
finds that it is in the best interest of the health, welfare and
rights of the residents of the City of Winslow, now therefore

.ORDAIN AS FOLLOWS:
Section 1. Definitions.
Chapter 18.12 of the Winslow Municipal Code "Definitions" is
hereby amended as follows:
Section 18.12,210 Dwelling, multifamily
Shall be amended to read in its entirety:
"Dwelling, multifamily" means a structure or portion of
a structure containing two or more dwelling units and having a
permanent foundation.
Section 18.12.220 Dwelling, single-family
Shall be amended to read.in its entirety:
"Dwelling, single-family" means any building or
structure, including: site built homes, factory built homes,
panelized homes and kit built homes, containing one dwelling
unit, that is built on a permanent foundation and is in
compliance with the standards of the Uniform Building Code (UBC).
This definition does not include manufactured homes.

Section 18.12.244 Factory ~uilt Home
New definition:
"Factory Built ~ome" means any .building or structure,
containing one dwelling unit, that is constructed primarily in a
factory, does not contain a permanent chassis and is transported
to the site for assembly and installation on a permanent
foundation. Such dwellings shall be constructed in compliance
with the standards of the Uniform Building Code and must have the
insignia of approval of the Washington State Department of Labor
and Industries, in accordance with RCW 43.22.
Section 18.12,388 Kit Home
New definition:
"Kit Home" means any building or structure, containing
one dwelling unit, that is constructed primarily in a factory as
a set of pre-cut materials and parts, that does not contain a
permanent chassis and is transported to the site for assembly and
installation on a permanent foundation. Such dwellings shall be
constructed in compliance with the standards of the Uniform
Building Code.
Section 18.12.482 Manufactured Home
New definition:
"Manufactured Home" means any building or structure,
containing one dwelling unit, that is constructed primarily in a
factory, contains a permanent chassis, and is transported to the
site for assembly and installation on a permanent foundation.
Such dwellings shall be constructed in compliance with the
Federal Manufactured Home Construction and Safety Standards and
must have the insignia of approval of the U.S. department of
Housing and Urban Development, in compliance with RCW 43.22.
Section 18.12,484 Manufactured Home Development
New definition:
"Manufactured Home Development" means a site developed as a
planned Unit Development for the permanent placement of
manufactured homes.
Section 18.12,490 Mobile Home
Shall be amended to read in its entirety:

Section 18.12,500 Mobile Home Park
Shall be amended to read:in its entirety:

Section 18.12.588
New definition:
Panelized Home
"Panelized Home" means any building or structure,
containing one dwelling unit, 'that is constructed primarily in a
factory, as a set of panels, that does not contain a permanent
chassis and is transported to the site for assembly and
installation on a permanent foundation. Such dwellings shall be
constructed in compliance with the standards of the Uniform
Building Code.
Section 18.12.616
New definition:
Permanent Foundation
"Permanent Foundation" means a.foundation constructed
in compliance with the standards of'the Uniform Building Code,
except foundations for manufactured homes shall be in compliance
with the printed installation instructions provided by the
manufacturer of the manufactured home.
Section 18.12.692
New definition:
Site Built Home
"Site Built Home" means any building or structure,
containing one dwelling unit, that is constructed primarily on
site on a permanent foundation. Such dwellings shall be
constructed in compliance with the standards of the Uniform
Building Code.
Section 2. High Density Multifamily Residential Zone.

Section 5. Add New Chapter to Winslow Municipal Code:
Chapter 18.91 Manufactured Home Provisions
Section 18.91,010 Manufactured Home Developments
All Manufactured Home Developments shall be accomplished through
the Planned Unit Development process of Chapter 18.40. All
Manufactured Home Developments shall be three acres or larger,
and shall contain only Manufactured Homes and accessory
buildings.
Section 18.91.020 inspection
The Building Official shall inspect the installation of
Manufactured Homes prior to occupancy and issue certificates of
occupancy after all city requirements have been met. No
Manufactured Home shall be occupied until after a valid
certificate of occupancy has been issued.
If a Manufactured Home is replaced by another Manufactured Home,
a new certificate of occupancy shall be required.
Section 18.91,030 Non-Conforming Manufactured Homes
A Manufactured Home, which was legally placed and maintained
prior to the date of adoption of this ordinance, and does not
meet the requirements of this ordinance, shall be deemed to be a
legal non-conforming structure.
If a legal non-conforming Manufactured Home ~s damaged to an
extent exceeding seventy-five percent (75%) of the replacement
cost of the entire building, exclusive of foundations, it shall
not be repaired, replaced or reconstructed unless it'is done to
conform to the development requirements of the zone in which it
is located. The extent of damage shall be determined by the City
Engineer.

Section 6. Severability.
If any portion of this ordinance is found or rendered
invalid or ineffective, all remaining provisions shall remain
in full force and effect.
Section 7. This ordinance shall take effect and be in force five
days after its passage and legal publication.
ADOPTED this 7th day of December , 1989 and signed in
authentication of its passage on the same date hereof.
