ORD 90-04 VACATING WALKWAY BY WHITED'S PLAT OF COMMODORE90 JUL -5 PM I: 4 ! ~ ORDIN~CE of the City of Winslo~'[~YL '~ Washington, vacating a walkway abutting .................. Lots 3 and 4, Whited's Plat of Co~odore, ['~--~) First Addition to the City of Winslow. WHEREAS, a petition was filed with the City Council by the owners of Lots 3 and 4, Whited's Plat of Commodore, First Addition to the City of Winslow, as recorded in Volume 17 of Plats, pages 31 through 33, Records of Kitsap County, Washington, (the "Lots") to vacate a ten-foot wide walkway between the Lots; and WHEREAS, by motion the City Council fixed January 4, 1990, at 7:30 p.m., as the time and place for a hearing on the petition; and WHEREAS, notice of the pendency of the petition and of the hearing was posted in the manner provided by law and published, and the hearing was held by the City Council on the date and at the time above-mentioned; and WHEREAS, the walkway has never been developed or used for public purposes or as a pedestrian access or alley and has been consistently incorporated into the landscaping of the Lots; and WHEREAS, the owners of the Lots have ordered a title report of the ownership of the walkway; and WHEREAS, good; and vacation of the walkway would serve the public WHEREAS, the City desires to vacate the walkway pursuant to RCW 35A.47.020 and chapter 35.79 RCW; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN as follows: Section 1. The ten-foot wide section of real property located between Lots 3 and 4, Whited's Plat of Commodore, First Addition to the City of Winslow, as recorded in Volume 17 of Plats, pages 31 through 33, Records of Kitsap County, Washington, is vacated one-half each to the owners of those Lots 3 and 4. Section 2. The City shall pay to the owners of the Lots one-third of the cost of preparation of the title report ordered by those owners to determine ownership of the property vacated in Section 1, up to a maximum of $100.00. - i- REEL54 FR1G[ 5 kj w/OO45R 9007050147 Section 3.
