ORD 90-15 SPECIAL FLOOD HAZARD AREASORDINANCE NO. 90 - 15
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON,
AMENDING ORDINANCE NO. 88 - 22, AND AMENDING CHAPTER
15.16 OF THE WINSLOW MUNICIPAL CODE ENTITLED SPECIAL
FLOOD HAZARD AREAS.
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 2. Ordinance No. 88-22, relating to Section
15.16.010 Winslow Municipal Code, sub title A. (8) which follows (5)
is amended and is replaced by (6) to read as follows:
(6) To ensure that those who occupy the areas of special flood
hazard assume responsibility for their actions.
Section 2. Section 2. Ordinance No. 88-22, relating to Winslow
Municipal Code Section 15.16.030 General Provisions, sub title B. is
amended as follows:
B. BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD
HAZARD
The areas of special flood hazard identified by the Federal
Insurance Administration in a scientific and engineering report
entitled, "The Flood Insurance Study for the City of Winslow"
dated February 5, 1986, with accompanying Flood Insurance
Maps is hereby adopted by reference and declared to be a part
of this ordinance. The Flood Insurance Study is on file at the
office of the City Clerk.
Section 3. Section 2. Ordinance No. 88-22, relating to Winslow
Municipal Code Section 15.16.040 Establishment of Development
Permit, second sub title C. Variance Procedure, following D., is
amended and is replaced by E. VARIANCE PROCEDURE.
Section 4. Section 2. Ordinance No. 88-22, relating to
Winslow Municipal Code Section 15.16.040 Establishment of
Development Permit, sub title 2.(a) and 2.(e)(iii) is amended as
follows:
(a) Generally, the only condition under which a variance from
the elevation standard may be issued is for new construction
and substantial improvements to be erected on a lot of one-
half acre or less in size contiguous to and surrounded by lots
with existing structures constructed below the base flood
level,providing items (i-xi)in Section 15.16.04 1.(d) have been
fully considered. As the lot size increases the technical
justification required for issuing the variance increases.
(e)(iii) a determination that the granting of a variance will
not result in increased expense, create nuisances, cause fraud
on or victimization of the public as identified in Section
15.16.040 E l(d), or conflict with existing local laws or
ordinances.

Section 5. Section 2. Ordinance No. 88-22, relating to
Winslow Municipal Code Section 15.16.050 General Standards, sub
title G.(2) is amended as follows:
(2) Construction or reconstruction of residential structures is
prohibited within designated floodways, except for (i) repairs,
reconstruction, or improvements to a structure which do not
increase the ground floor area; and (ii) repairs, reconstruction
or improvements to a structure, the cost of which does not
exceed 50 percent of the market value of the structure either,
(A) before repair, reconstruction, or improvement is started,
or (B) if the structure has been damaged, and is being
restored, before the damage occurred. Work done on
structures to comply with existing health, sanitary, or safety
codes or to structures identified as historic places shall not
be included in the 50 percent.
Section 6. This ordinance shall take effect and be in force five
days from and after its passage, approval, publication and posting as
required by law.
