ORD 91-50 AMEND BUDGET FOR SPARGUR LOOP SETTLEMENTORDINANCE No. 91 - 50
AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND
TO AMEND THE 1991 BUDGET IN ORDER TO APPROVE FUNDING
FOR THE SPARGUR LOOP ROAD END SETTLEMENT.
WHEREAS, on November 21, 1991, the City Council resolved in
Resolution 91-29 to authorize the Mayor to execute an agreement with the
Seattle Yacht Club in order to settle the Spargur Loop Road End dispute; and
WHEREAS, on December 19, 1991, the City Council resolved in
Resolution 91-33 to authorize the Mayor to execute escrow instructions and
other documents necessary to purchase property from Priscilla Cohen as part
of the settlement of the Spargur Loop Road End dispute; and
WHEREAS, Washington State law requires that amendments to
a City's budget to provide such funding be made by ordinance rather than by
resolution, now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS :
SECTION 1. The 1991 Budget shall be amended to permit the expenditure
of $119,248.00 from the City's Current Expense Fund for the purpose of
completing the purchase of property from Priscilla Cohen as described in
Resolutions 91-29 and 91-33 in order to complete a settlement of this
dispute.
SECTION 2. This ordinance shall be published in the official newspaper
of the City, and shall take effect and be in full force five (5) days after
publication.
