ORD 91-06 TAKE-OUT FOOD RESTAURANTSORDINANCE NO. 91-06
AN ORDINANCE of the City of Winslow,
Washington, relating to formula take-out
food restaurants and amending section 1 of
Ordinance No. 89-28.
WHEREAS, by Ordinance No. 89-28, passed in July, 1989, the
City Council prohibited the operation of formula take-out food
restaurants in the City of Winslow; and
WHEREAS, by passing Ordinance No. 89-28, the City Council
intended to prohibit the operation of formula take-out food
restaurants whether or not the food prepared by the restaurant
is consumed primarily on the premises; and
WHEREAS, the City Council desires to amend Ordinance
No. 89-28 to prohibit expressly the operation of formula
take-out food restaurants that serve or deliver food for
consumption primarily off the premises; now, therefore
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN as follows:
Section 1. Section 1 of Ordinance No. 89-28 is amended as
follows:
(Chapter 18.12 of the Winslow Municipal
Code entitled Definitions is hereby anended
to add the following definition) A new
Section 18.12.265 is added to the Winslow
Municipal Code as follows:
(Formula Take -Out Food Restaurant)
"Formula Take -Out Food Restaurant" means a
restaurant or establishment that (1) is
required by contractual or other arrangement
to offer standardized menus, ingredients,
food preparation, interior or exterior
design and/or uniforms(;) and (2) serves or
delivers its food in disposable containers.
Section 2. This ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as required by law.
