ORD 91-02 ANNEXATION OF UNINCORPORATED TERRITORYORDINANCE NO. 91- O �. AN ORDINANCE of the City of Winslow, Washington, providing for the annexation of the unincorporated territory of Bainbridge Island to the City of Winslow and for the adoption of land use and zoning regulations for that territory, and establishing 12:01 a.m. on February 28, 1991, as the effective date of such annexation. WHEREAS, by Resolution No. 90-18, adopted on March 14, 1990, the City Council determined and found that the best interests and general welfare of the City of Winslow and the unincorporated territory of Bainbridge Island would be served by the annexation of that unincorporated territory to the City of Winslow, and called for a special election to be held on the annexation proposal; and WHEREAS, pursuant to a notice of intention to annex filed by the City of Winslow, the Kitsap County Boundary Review Board approved the proposed annexation by failing to invoke jurisdiction; and WHEREAS, by Ordinance No. 90-17, passed on July 9, 1990, the City Council adopted proposed land use and zoning regulations for the unincorporated territory of Bainbridge Island to become effective upon annexation of that unincorporated territory to the City of Winslow; and WHEREAS, at a special election held on November 6, 1990, a majority of the voters residing in the unincorporated territory of Bainbridge Island approved the annexation of that territory to the City of Winslow and approved the proposed land use and zoning regulations contained in Ordinance No. 90-17; and WHEREAS, the City Council finds that the best interests and general welfare of the City of Winslow and the unincorporated territory of Bainbridge Island will be served by the annexation of that unincorporated territory to the City of Winslow; now, therefore THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The unincorporated territory of Bainbridge Island, Washington, more particularly described on - 1 - Lr/0844R Exhibit A and depicted on Exhibit B, both of which are attached hereto and made a part hereof, shall be annexed to the City of Winslow at 12:01 a.m. on February 28, 19911 and thereafter shall be subject to the zoning and land use regulations adopted by the City of Winslow in Ordinance No. 90-17. Section 2. The territory annexed to the City of Winslow pursuant to Section 1 herein, shall not be subject to the general indebtedness of the City existing at the effective date of the annexation. Section 3. The City Clerk is authorized and directed to file a certified copy of this ordinance with the Kitsap County Auditor, the Kitsap County Board of Commissioners, the Washington State Office of Financial Management, and such other governmental offices and agencies as may be required by law or regulation. Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval, publication and posting as required by law.
