WHEREAS, Michael McCann filed an application for the rezone of Lot 13 of Madrona Park Heights Plat, located at 689 Park Avenue from single-family (R-2.9) to single-family (R-3.5); and WHEREAS, on April 23, 1992, the Planning Agency reviewed the application and thereafter transmitted its recommendation of approval to the Hearing Examiner; and WHEREAS, on July 23, 1992, the Hearing Examiner held a public hearing on the application upon proper notice; and WHEREAS, on August 12, 1992, the Hearing Examiner entered her findings of fact, conclusions of law and decision (recommendation) of approval on the application to the City Council; and WHEREAS, on October 1, 1992, the City Council considered the recommendation of the Hearing Examiner and concurred in the findings of fact, conclusions of law and decision (recommendation) of the Hearing Examiner; and WHEREAS, the City Council has determined that the public use and interest will be served by a rezone of the property; and WHEREAS, the City has complied with the requirements of the State Environmental Policy Act and the City's Environmental Policy Ordinance; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City Council adopts the findins of fact, conclusions of law and decision (recommendation) of the Hearing Examiner in the Matter of Application for Rezone, Michael McCann, applicant, File No. RZ10-09-91-1, attached hereto and by this reference incorporated herein as Exhibit A. Section 2. The property described on Exhibit A is rezoned from single family (R-2.9) to single-family (R-3.5), and the official zoning map of the City is amended accordingly. The Director of Planning and Community Development, or her designee, is authorized and directed to carry out the amendment of the Official Zoning Map of the City and to record a certified copy of this ordinance with Kitsap County Auditor. Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval, publication and posting as required by law. 1992.
