ORD 92-18 DISCHARGE OF FIREWORKSORDINANCE N0.92-18 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to the discharge of fireworks in the City during the calendar year 1992; establishing conditions for a fire safe Fourth of July holiday; and declaring an emergency. THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN as follows: Section 1. Findings of Fact. A. The Bainbridge Island City Council finds that Kitsap County is currently experiencing unusually low rain fall and drought-like conditions. Based on information provided by the Weather Bureau, May 1992 was the driest May since 1947. The rainfall in May 1992 was approximately .12 inches. The average rain fall for the month of May is approximately 1.6 inches. Rainfall to date in June 1992 has also been below average for the month. B. The lack of precipitation has created an extreme danger of fire within the City. Section ~. For the calendar year 1992 only, Section 5.36.110 of the Bainbridge Island Municipal Code is amended as follows: 5.36.110 Dates and Times when Sale or Discharge Permitted. A. No common fireworks shall be sold within the City except from 12:00 noon on the 28th of June to 12:00 noon on the 6th day of July of each year. No common fireworks may be sold between the hours of 11:00 PM and 9:00 AM. B. NO fireworks shall be discharged within the City except between 9:00 AM and 11:00 PM on the 4th of July. Fireworks may only be discharged when there is an extinguishing device such as a fire extinguisher, water hose, bucket of water, or shovel and sand at the discharge area. Fireworks shall not be discharged under any circumstances in an area near vegetation or structures which could be ignited. C. All persons commercially selling fireworks shall post a permanent sign indicating that in 1992, as a result of fire-hazardous conditions, discharge of fireworks shall be limited to the time and date in paragraph B. Retailers are encouraged to cease selling fireworks in 1992 at 11:00 PM, July 4, 1992. Section 3. Effective Date. This ordinance, adopted by a majority plus one of the membership of the City Council, is a public emergency ordinance necessary for the protection of the public health, safety, property and peace, and shall take effect and be in force immediately upon its passage.
