AN ORDINANCE of the City of Bainbridge Island, Washington,
amending the Official Zoning Map of the City to rezone Lots 1,
2 and 3 of the McLaughlan Highland short plat, located at Ihland
Way and Nakata Avenue, from medium density multi-family (R-8)
to high density single-family (R-4.3).

WHEREAS, The Madison Avenue Partnership filed an application for the rezone of
Lots 1, 2 and 3 of McLaughlan Highland short plat, located at Ihland Way and Nakata Avenue,
from medium density multi-family (R-8) to high density single-family (R-4.3); and
WHEREAS, on April 9, 1992, the Planning Agency reviewed the application and
thereafter transmitted its recommendation of approval to the Hearing Examiner; and
WHEREAS, on May 12, 1992, the Hearing Examiner held a public hearing on the
application upon proper notice; and
WHEREAS, on May 15, 1992, the Hearing Examiner submitted her findings of fact,
conclusions of law and recommendation of approval on the application to the City Council; and
WHEREAS, on May 21, 1992, the City Council considered the recommendation of the
Heating Examiner and concurred in the findings of fact, conclusions of law and
recommendation of the Hearing Examiner; and
WHEREAS, the City Council has determined that the public use and interest will be
served by a rezone of the property; and
WHEREAS, the City has complied with the requirements of the State Environmental
Policy Act and the City's Environmental Policy Ordinance; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO.ORDAIN AS FOLLOWS:
Section 1. The City Council adopts the findings of fact, conclusions of law and
recommendation of the Hearing Examiner in the Matter of Application for Rezone, The
Madison Avenue Partnership, applicants, File No. RZ11--06-91-1, attached hereto and by this
reference incorporated herein as Exhibit A.
Section 2. The property described on Exhibit B, attached hereto and by this reference
incorporated herein, is rezoned from medium density multi-family (R-8) to high density single-
family (R-4.3), and the official zoning map of the City is ranended accordingly.
Section 3. The Director of Planning and Community Development, or her designee,
is authorized and directed to carry out the amendment of the Official Zoning Map of the City
and to record a certified copy of this ordinance with the Kitsap County Auditor.

Section 4. This ordinance shall take effect and be in force five days from and after its
passage, approval, publication and posting as required by law.
