ORD 93-43 STORM & SURFACE WATER UTILITY FEESORDINANCE NO. 93 - 43 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to storm and surface water utility fees; amending Section 13.24.086 and Section 13.24. 100 of the Bainbridge Island Municipal Code. WHEREAS, Chapter 13.24 BIMC establishes a storm and surface water utility for the City for the purpose of combatting erosion and flooding, contamination of shellfish beds, pollution and sedimentation of streams and bays, and other problems resulting from run-off of rainwater throughout the City; and WHEREAS, RCW 84.56.035 authorizes the City to contract with Kitsap County for the collection of the City's rates or charges; and WHEREAS, the City intends to enter into a contract with Kitsap County whereby the Kitsap County Treasurer will collect the City's storm and surface water utility fees; and WHEREAS, under the contract, the Kitsap County Treasurer will bill property owners within the City for the City's storm and surface water utility fees at the time that the County bills the property owners for property taxes; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON DO ORDAIN as follows: Section 1. Section 13.24.086 of the Bainbridge Island Municipal Code is amended to read as follows: 13.24.086 Application for rate reductions - Appeal. A. In order to qualify for the rate reductions set forth in Sections 13.24.082 and 13.24.084, the property owner must file an application with the director of finance at least 30 days pfief to the billing date upefiby November 15 of the year prior to the year in which the rate reduction is to be effective. B. Any person aggrieved by any decision of the director of finance relating to an application for the rate reductions authorized by sections 13.24.082 and 13.24.084 may appeal the director's decision by filing a writ of review with the superior court of the county within 30 days of the date of the director's decision. Section 2. Section 13.24. 100 of the Bainbridge Island Municipal Code is amended to read as follows: 13.24.100 Billing and payment. If storm and surface water utility fees are not laid by the due date, the account shall be delinquent. All delinquent accounts will be subject to a monthly penalty charge of 1 % of the amount that is delinquent. Section 3. This ordinance shall take effect and be in force on January 1, 1994.
