ORD 93-23 INTERIM STANDARD FOR STREETS & ROADSORDINANCE NO. 93-23
AN ORDINANCE of the City of Bainbridge Island, Washington,
relating to interim standards for streets and roads; amending
Sections 12.28.020, 12.28.030, 12.30.010, 12.32.050, 12.32.060,
and subsections 8-A and 11-A and the subsection entitled
"Improvements" of Appendix A of Title 17 of the Bainbridge
Island Municipal Code; and adding a new Chapter 12.36 to the
Bainbridge Island Municipal Code.
WHEREAS, the City Council desires to establish interim road design standards for
public roads and streets throughout the City; and
WHEREAS, the City has coordinated the design and construction of streets and roads
throughout the City with agencies having jurisdictions in the City; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. There is added to the Bainbridge Island Municipal Code a new
Chapter 12.36 as follows:
.010 Interim Street and Road Standards.
All streets and roads to be constructed in the public right-of-way,
whether opened or unopened, or to be constructed in a private right-of-way
where there is a high probability of the street or road being dedicated to the
City, as determined by the director of public works, shall meet the following
standards set forth in Appendix A of this chapter:
1. City of Bainbridge Island Roadway Standards - Interim, dated
May, 1993.
2. Street Standard - Secondary Arterial - Urban/Suburban (Drawing
No. RSBI-1).
3. Street Standard - Secondary Arterial - Rural/Semi-Rural (Drawing
No. RSBI-2).
4. Street Standard - Collector - Urban/Suburban (Drawing No. RSBI
- 3).
5. Street Standard - Collector - Rural/Semi - Rural (Drawing
No. RSBI - 4).
6. Street Standard - Residential - Urban/Suburban (Drawing
No. RSBI - 5).

.020 Changes to Standards.
The director of public works, or the director's designee, shall consider
existing streets and roads when applying the standards set forth in section .010,
and is authorized to adjust the standards to take into account the discrepancies
between existing streets or roads and the streets or roads to be constructed, and
the need to serve the citizens of the city on a cost-effective basis.
Section 2. Section 12.28.020 of the Bainbridge Island Municipal Code is amended
to read as follows:
All projects requiring a building permit and located on property abutting
any proposed sidewalk as shown on the comprehensive sidewalk plan or as
required by chapter 12.36 shall provide sidewalks and curbs along the street
front. Such sidewalk construction shall meet the approval of the city engineer
and shall provide appropriate curb crossings for vehicular ingress and egress;
provided, this section shall not apply to minor remodeling or repair which does
not increase the size or area of a structure existing on June 1, 1984.
Section 3. Section 12.28.030 of the Bainbridge Island Municipal Code is amended to
read as follows:
Construction standards for sidewalks shall be the same as required for
subdivisions and short subdivisions and shall be in compliance with
chapter 12.36. In addition, the developer or abutting owner shall pave to city
standards and specifications any unpaved portion of the right-of-way between the
newly constructed curb and the existing road pavement.
Section 4. Section 12.30.010 of the Bainbridge Island Municipal Code is amended to
read as follows:
No building permit, subdivision, short subdivision or planned unit
development shall be approved or granted until the owner of the affected
property dedicates to the city the portion of land designated on the official street
map or required by chapter 12.36 as a street right-of-way. Dedications may
also be required as a condition of approval for variances and conditional use
permits. Upon a finding of good cause, the director of planning and community
development, with the concurrence of the director of public works, may grant
an exception from the street dedication requirement; provided, that no

exemption shall be granted which would be materially detrimental to the public
welfare or injurious to property located in the vicinity of the affected property.
Section 5. Section 12.32.050 of the Bainbridge Island Municipal Code is amended to
read as follows:
Road improvements shall be constructed in accordance with chapter 12.36.
Section 6. Section 12.32.060 of the Bainbridge Island Municipal Code is amended to
read as follows:
A. Plans. Detailed engineering plans and/or a drainage study may
be required when considered necessary by the director of public works or
otherwise required by law. Costs for the development of such plan and costs
of required studies shall be borne by the permit applicant. When required, such
plans and study shall be in accordance with the requirements for plat
development.
B. Survey. When considered necessary by the director of public
works to adequately define the limits of right-of-way, the permit applicant shall
cause the right-of-way to be surveyed by a licensed land surveyor. Such survey
shall be recorded in accordance with the survey recording act.
C. Dedication.
1. A permit applicant shall be required to deed additional
right-of-way across property under the applicant's authority when necessary to
fulfill the minimum road right-of-way width prescribed by chapter 12.36.
2. Slope, wall and drainage easements beyond the right-of-
way line may be required to be dedicated by the director of public works.
D. Illegal subdivision. A permit shall not be issued to provide access
to a lot or parcel created in violation of then existing platting law.
Section 7. Subsections 8-A and 11-A and the subsection entitled "Improvements" of
Appendix A, Title 17 of the Bainbridge Island Municipal Code is amended to read as follows:
8. Walks or pedestrian ways shall be required in accordance
with chapter 12.36 or when the planning commission determines they are
necessary to provide access to schools, parks and playgrounds, public facilities,
water bodies or tidelands.

11. The minimum width of street rights-of-way and access
easements, width of improved surface, and the maximum grade of various
streets, shall be as set forth in the following table:

Improvements.
In addition to other requirements, improvements shall conform to the
requirements of state law, this title and detail improvement standards or
specifications adopted by the city of Bainbridge Island. The city engineer shall
be responsible for preparing such standards and all construction and installation
work shall be accomplished under his direction. Minimum improvements are
summarized as follows:
1. Streets shall be constructed and graded to full right-of-way widths
and constructed in accordance with chapter 12.36 and paragraph 11 of
subsection A of these subdivision standards.
2. Curbs shall be required in accordance with chapter 12.36.
3. Storm sewers and appurtenances shall be sufficient to carry run-
off or flood waters generated by the 100 -year storm characteristic to the area
included in the proposed plat, subdivision or dedication.
4. Sidewalks shall be required in accordance with chapter 12.36.
Wherever sidewalks are not installed, five-foot footpaths may be required on a
case by case basis. Handicap access shall be included on any pedestrian or
walkway provided.

5. The water distribution system shall include fire hydrants, and a
service connection for each lot and shall be installed in accordance with city
standards.
6. The subdivision shall be provided with a complete sanitary sewer
system where a public sewer main lies within 800 feet of the proposed
subdivision. The system shall be constructed in accordance with city standards.
If a public sewer main is not located within 800 feet of the proposed
subdivision, septic tanks, or other approved methods of handling wastes may be
installed. Where septic tanks are proposed, percolation standards must be met
and the minimum lot area for each septic tank system shall be determined by
analysis of the soil conditions. In no case shall the lot area be less than 20,000
square feet when septic tanks are to be used.
7. All utility service lines including electric, communications, fire
alarm and television cables shall be placed underground.
8. Street lights shall be required. In addition to underground wiring,
the light standard base and luminaries shall be provided and installed at the
subdividers expense.
9. All signs in the public right-of-way shall conform to the manual
on Uniform Traffic Control Devices and shall be installed by the applicant.
Section 8. This Ordinance shall be effective five (5) days from and after its passage,
approval, publication, and posting as required by law.
