ORDINANCE NO. 93 - 18
AN ORDINANCE of the City of Bainbridge Island, Washington,
relating to sewer liens, and amending Sections 13.16.090 and
13.24. X20 of the Municipal Code to extend the period in which a
sewer lien is effective without the necessity of a writing or
recording of the lien with the County Auditor.

WHEREAS, RCW 35.67.210 provides that a sewer lien shall be effective for a total of
not to exceed six month's delinquent service charges without the necessity of any writing or
recording of the lien with the county auditor; and
WHEREAS, pursuant to RCW 35,67.215, the City may by ordinance provide that a
sewer lien shall be effective for up to one year's delinquent service charges without the necessity
of any writing or recording of the lien with the county auditor; and
WHEREAS, the City Council desires to extend the period from six months to one year;
now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Se tG ion 1. Section 13.16.090 of the Bainbridge Island Municipal Code is amended to
read as follows:
A. All charges for sanitary sewage disposal service and for connections thereto,
together with penalties and interest tbert= as provided in this title and by statute, shall be a lien
upon the property to which such connection is made or such service furnished, sup;,rior to all
other liens or encumbrances except those for general taxes, special assessments, and city water
service. A sewer lien shall be effective fora total not to exceed one year's jehliquent Service
charges without the necessity of any writing or recordingQf the lien with the count
y audit r.
Enforcement and fore&losure of any sewer lien shall be in the planner

B. As an additional and concurrent method of enforcing (14�ejj sewer lien
authorized by this section and state law, the city may shut off the water service to titre prenuses
to which such sewer service was furnished or connections mads after the charges became
delinquent and unpaid, until the charges ar'-, paid, subject to the conditions set fonh in state law.
C. All charges for water service small be a lien upon the prernisc_ and shaU be
enforceable by shutting off watez se:r,fice until tate delinquent bill is paid. subject to the
conditions set forth in state. lay. 'X -hen water service is shut off pursuant to this sectio; the
water shall not be turned on again until the bill is paid together with a ton on charge as
established by resolution of the city council.

Section 2. Section 13.24.120 of the Bainbridge Island Municipal Code is amended to
read as follows:
Pursuant to RCW 35.67.200, et seq., the city shall have a lien for delinquent and unpaid
stormwater sewer charges. A sewer lien shall be effective for a t tal not to exceed one year's
delinquent service charges without the nececsity of any wri 'ng or recording of the lie with the
bounty auditor. Enforcement and foreclosure of any Sewer lien sh 11 be in_the manner pr vid
by state law. ((E -H .)) Interest
on the unpaid balance shall be eight percent per annum or higher rate as authorized by law.
Section 3. This ordinance shall take effect and be in force five days from and after its
passage, approval, publication, and posting as required by law.
