RES 2005-31 DONALD AVENUE VACATION PUBLIC HEARINGRESOLUTION NO. 2005-31
A RESOLUTION of the City of Bainbridge Island,
Washington, fixing a time and place for a public hearing to
consider for vacation a portion of Donald Avenue.
WHEREAS, The City of Bainbridge Island is expanding the Donald Avenue
sewage treatment plant; and
WHEREAS, a portion of said expansion must occur within the right-of-way of
Donald Avenue; and
WHEREAS, The City of Bainbridge Island is the owner of more than 90 % of the
parcels adjoining the section of street to be vacated; and
WHEREAS, Chapter 12.34.020 of the municipal code states in part, "the city
council may itself initiate a vacation by resolution."
NOW, THEREFORE, be it resolved by the City Council of the City of
Bainbridge Island, Washington:
Section 1. A public hearing shall be held on the requested vacation of a
portion of Donald Avenue, described on the attached drawings, Exhibit A on October
26, 2005 as part of the regular City Council meeting at the Bainbridge Island Council
Chambers located at 280 Madison Avenue N.
Section 2. The Director of Public Works or designee is authorized and
directed to post and mail notices as required by RCW 35.79.020, and to notify the public
of the public hearing at least twenty days prior to the hearing.
