ORD 94-13 ANIMAL ADVISORY COMMITTEEORDINANCE NO. 94 - 13 - AN ORDINANCE of the City of Bainbridge Island, Washington, relating to animal control within the City; establishing an animal advisory committee; amending Sections 6.04. 115 and 6.08.03 1) of the Bainbridge Island Municipal Code; and adding a new section to Chapter 6.04 of the Bainbridge Island Municipal Code. WEmREAS, the City has received and considered input from the public regarding the City's animal control code; and WHEREAS, the City Council has determined that it is in the best interests of the City to amend the definition of wild animal set forth in BIMC 6.04.115, and to establish an animal control committee to provide recommendations to the City Council regarding animals which may be kept within the City; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN as follows: Section 1. Section 6.04. 115 of the Bainbridge Island Municipal Code is amended to read as follows: • z:� • • .S, • 11170M,41 A. It is unlawful for any person to own, possess, maintain, harbor, or transport to sell, within the city any living wild animal. Zoological gardens, circuses, rodeos, or livestock shows licensed by the city are excepted, as is any federally and state licensed sanctuary. B. For the purposes of this section, the term "wild animal" means and includes any and all species of : 1. Poisonous reptiles and poisonous arachnids; 2. Crocodilians; 3. Wolves and wolf -hybrids; 4. All species of non -human mammals, except domestic cats and dogs, domestic ferrets, domestic rodents, domestic rabbits, African pygmy hedf ho_as_ and domestic species of livestock, including all camelids,jwd.exppt any species designated by city council resolution as an exception to the definition of wild animal Any animal designated by resolution shall be approved by the United States Department of Agriculture as an exempt exotic animal. by FADMMPAI.\0057539.01 08/26/94 - 1 - = N -•,Jill -1 ligm Ki.. !4- .•• Section 2.. A new section is added to Chapter 6.04 of the Bainbridge Island Municipal Code to read as follows: 6.04.117 Animal advisoa committee established. There is established an animal advisory committee, which shall investigate the environmental impact and other public safety concerns connected with species excepted from the definition of wild animal under BIMC 6.04.115B.4. The committee shall consist of three persons appointed by the mayor and confirmed by the city council, and shall consist of one member from each of the following groups: (1) the investigative authority contracted by the City for animal control; (2) local veterinarians and specialists in the field of exotic animals; and (3) members of the public at large. The committee shall establish criteria for recommending species to the city council for exception from the definition of wild animal, and shall evaluate species and submit its recommendations to the city council for approval by resolution. The committee shall provide adequate notice of its evaluation of species to local pet stores, animal welfare organizations, and other interested persons and groups requesting notice. Section 3. Section 6.08.03IJ of the Bainbridge Island Municipal Code is amended to read as follows: J. Inspections. rae animal control authority shall inspect existing or proposed commercial kennels, catteries, pet shops and animal shelters in connection with its licensing investigation and when inspections are necessary to insure compliance with this chapter. Inspections shall be made during regular business hours. Copies of United States Department of Agriculture documents relating to exotic species excepted from the definition of wild animal under BIMC 6.04.115B.4 shall be made available to animal control authorities on =guest, Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law.
