ORD 95-12 CHAUTAUQUA REPLAT ORDINANCE NO. 95-12
AN ORDINANCE of the City of Bainbridge Island, Washington vacating
that portion of Chautauqua Replat Streets abutting Replat Tax Lot
No.'s 4156-002-005-0203.
WHEREAS, Raymond Ramsdell, representative for Soundcare Inc., the owners of Lot # 4156-
002-005-0203 filed a petition with the City Council to vacate a portion of 4156-002-005-0203 legally
described on Exhibit A (map) attached hereto and incorporated by this reference, and
WHEREAS, by Resolution No. 94-49 adopted on December 15. 1994, the City Council set
a public hearing on the petition before the Public Works Committee on January 23. 1995 at 7:00 p.m.,
and
WHEREAS, the Committee held the hearing at the scheduled time and recommends the identified
rights-of-way be vacated, and
WHEREAS, the petitioners have complied with the provisions of Chapter 12.34 of the Municipal
Code, including payment of the full appraised value of the rights-of-way to be vacated; and
WHEREAS, the City Council desires to vacate the right-of-way; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. All streets, lanes and road right-of-ways situated within that portion of the Plat
of Chautauqua Replat of Lot 11, Block 1 and Lot 6, Block 2 of Manitou Park, is vacated to Soundcare
Inc., the owners of Tax Lot No. 4156-002-005-0203, subject to retention of the right of the City of
Bainbridge Island to exercise and grant easements for the construction, repair and maintenance of public
utilities and services.
Section 2. This Ordinance shall be effective five (5) days from and after it's passage, approval,
publication, and posting as required by law.
