ORD 95-16 AMENDING COMPREHENSIVE PLANORDINXNC~e NO, 95 - 16
AN ORDINANCE of the City of Bainbridge
Island, Washington, amending the City's
Comprehensive Plan; and adding new sections
2(6) and 2(7) to Ordinance 94-21.
WHEREAS, the Central Puget Sound Growth Management Hearings
Board dismissed the appeal ~y Pauline and Bob Deschamps regarding
the City's Comprehensive Plan and remanded the same for the City
to reconsider the land Use designation of High School Road II on
the Deschamps and Fitzgerald properties, Tax Lot Numbers 232502-
3-026, 232502-3-027, 232502-3-030, 232502-3-036, and 232502-3-
043, located on the northeast comer of High School Road and SR
305; and
WHEREAS, Policy W 6.3 in the Land Use Element of the City's
Comprehensive Plan generally describes the uses and limitations
in the High School Road II district; and
WHEREAS, the zoning information received from Kitsap County
and relied upon by the City in preparation of the 1994
Comprehensive Plan inaccurately depicted the Knudsen
(Lumberman's) 5 acre parcel as R-3 instead of Business General
(BG) now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN as follows=
Section 1. There is added a new section 2(6) to Ordinance
94-21 of the City of Mainbridge Island as follows:
(6) Land Use Element, p. 65
Land Use Element Policy W 6.3 is amended as follows:
"The properties designated on the Land Use
Map as High School Road District II shall be
limited to retail sales with building
fo. otprints not exceeding 5000 square feet.
R~tail sales with building footprints between
5000 and 13000 square feet shall require a
conditional use permit."
Section 2. There is added a new section 2(7) to
Ordinance 94-21 of =he City of Bainbridge Island as follows:
(7} The High School Road II land use designation on the
real property with Tax Lot Numbers 232502-3-027 and 232502-3-030,
consisting of approximately 1.61 acres on the northeast corner of
High School Road and SR 305, is changed to Commerical High School
Road District on the City's Comprehensive Land Use Map.~
Section 3. Effective Date. This ordinance shall take
effect five days from and after its passage, approval, and
publication as required by law.
