ORD 95-23 METROPOLITAN PARK DISTRICTORDINANCE NO. 95 - 23 AN ORDINANCE of the City of Bainbridge Island, Washington, declaring the City's intent to submit the proposition of creating a metropolitan park district to the voters of the City; providing for the submission of the proposition to the voters of the City at a special election to be held on September 19, 1995; and requesting that the Kitsap County Auditor call that election. WHEREAS, the Bainbridge Island Park and Recreation District has determined that the formation of a metropolitan park district under Chapter 35.61 RCW will provide the most efficient and effective provision of public park and recreation facilities and programs, and the most stable funding base for such facilities and programs; and WHEREAS, the Bainbridge Island Park and Recreation District has requested that the City pass an ordinance declaring its intent to submit a proposition for the creation of a metropolitan park district to the voters of the City at the September 19, 1995 election; and WHEREAS, RCW 35.61.020 authorizes the City to, by ordinance, submit to the voters of the City the proposition of creating a metropolitan park district, the limits of which shall be coextensive with the limits of the City; and WHEREAS, the City Council has determined that the best interests of the public will be served by submitting the proposition of creating a metropolitan park district to the voters of the City at the September 19, 1995 election; and WHEREAS, RCW 35.61.030 requires that the ordinance be published once a week for two consecutive weeks in the official newspaper of the City; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN as follows: Section 1. Declaration of Intent. The City Council hereby declares its intent to submit to the qualified voters of the City the proposition of creating a metropolitan park district, the limits of which shall be coextensive with the limits of the City. Section 2. Finding of Emergency. The City Council finds that an emergency exists requiring that a special election be held within the City on the proposition of creating a metropolitan park district, the limits of which will be coextensive with the limits of the City. The Kitsap County Auditor is requested to concur in the finding of emergency, and to call and conduct a special election to be held in the City on September 19, 1995 in conjunction with the primary election to be held on that date, for the purpose of submitting to the qualified voters of the City the proposition of creating a metropolitan park district, the limits of which shall be coextensive with the limits of the City. Section 3. Ballot Proposition. The proposition to be submitted at the election shall be in the fom~ of a ballot title as follows: PROPOSITION FORMATION OF THE METROPOLITAN PARK DISTRICT OF THE CITY OF BAINBRIDGE ISLAND FOR THE FORMATION OF A METROPOLITAN PARK DISTRICT ...... AGAINST THE FORMATION OF A METROPOLITAN PARK DISTRICT Section 4. Creation of Metropolitan Park District. If at the election a majority of the voters voting thereon vote in favor of the formation of a metropolitan park district, the park district shall then be and become a municipal corporation and its name shall be "Metropolitan Park District of the City of Bainbridge Island." Section 5. Filing and Publication. The City Clerk is authorized and directed to file a certified copy of this ordinance with the Kitsap County Auditor, and to cause this ordinance to be published once a week for two consecutive weeks in the official newspaper of the City. Section 6. Effective Date. This ordinance shall take effect and be in force five days from and after its passage, approval, and publication as required by law.
