A RESOLUTION of the City of Bainbridge Island, Washington, approving the
The Pierce Corner Preliminary Plat (File No. SUB 13145)
WHEREAS, on April 22, 2005, a preliminary plat application was submitted by Spellman
Construction Inc. to the Department of Planning and Community Development; and
WHEREAS, the preliminary plat application facilitates creation of 14 residential lots
utilizing the cluster option on a 393 acre parcel located on the northwest corner of Wyatt Way
NW and Lovell Avenue NW; and
WHEREAS, the Department of Planning and Community Development reviewed and
forwarded its recommendation for conditional approval to the Hearing Examiner; and
WHEREAS, on October 13, 2005, the Hearing Examiner conducted a public hearing on
the preliminary plat: upon proper notice; and
WHEREAS, on November 10, 2005, the Hearing Examiner recommended conditional
approval of the preliminary plat and entered her Findings of Fact, Conclusions of Law, and
Recommendation; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. The Findings of Fact, Conclusions of Law and Recommendations of the
Hearing Examiner (File No. SUB13145), as set forth in Exhibit "A", which is attached and
incorporated by reference, is adopted as the final decision of the Bainbridge Island City Council
with the following revisions adopted by the City Council at its regular meeting of January 11,
2006:
Condition No. 3, B, iii. Construction permits for single-family residences shall contain a
planning requirement for the implementation and completion of the approved landscape design
before final inspection. This planning requirement shall apply to lots 9 — 14, along the Wyatt
Way frontage.
Condition No.3, B, v. Construction permits for single-family residences shall contain a

before final inspection. This planning requirement shall apply to lots 2 — 8, along the Al Dorsey
Lane frontage.
Condition 3, C, i. Prior to the issuance of any permit for clearing, grading, plat utilities, or
building, the Applicant shall obtain the Director's approval for a landscape plan for Tract A that

provides pedestrian access (i.e., "a walk in the woods") between the cul-de-sac and Wyatt Way.
This plan shall include the locations and identities (species and size) of appropriate native and
adapted non-native vegetation (including evergreen and deciduous trees), the location and
dimensions of the pedestrian path, and the location and dimensions of the driveway access to
adjacent Lot B. The landscape plan for Tract A shall be fully implemented and planting
complete and have final inspection and approval prior to final plat submittal. Assurance device
acceptable to the City may be used in lieu of physical completion.
Section 2. The proposed preliminary plat is in conformance with the zoning ordinance,
the comprehensive plan, the subdivision regulations and standards, and all applicable land use
ordinances and applicable state law in effect at the time the fully completed application for
preliminary plat approval was submitted by David Spellman, of Spellman Construction Inc., to
the Department of Planning and Community Development.
Section 3. The final plat of the Pierce Corner Subdivision shall state on its face that it is
subject to the conditions of approval set forth in this resolution.
PASSED by the Council of the City of Bainbridge Island, Washington, this 1 lth day of January,
2006.
