ORD 95-32 PROHIBIT UNMUFFLES COMPRESSION BRAKESORDINANCE NO. 95-32
AN ORDINANCE of the City of Bainbridge Island, Washington,
establishing a new section of the Bainbridge Island Municipal
Code which prohibits the use of unmuf~ed compression brakes,
provides for penalties therefore; and authorizes the Public Works
Department to post appropriate signage.
WHEREAS, the City Council of the City of Bainbridge Island finds that the use
of motor vehicle brakes which are activated or operated by the compression of the engine of a
motor vehicle disturbs and disrupts the public peace and quiet and, therefore, finds that it would
be in the best interest of the public health, safety and general welfare to prohibit the use of such
brakes, unless muffled.
NOW, THEREFORE, be it ordained, the City Council of the City of Bainbridge
Island do ordain as follows:
Section 1. Unmuffled Compression brakes prohibited.
No person shall use motor vehicle brakes within the city limits of the City of
Bainbridge Island which are in any way activated or operated by the compression
of the engine of the motor vehicle or any unit or part thereof unless the brakes
are muffled.
Section 2. Any person violating the provisions of this ordinance shall have
committed a traffic infraction and a maximum penalty of $250.00 shall be
imposed.
Section 3. The Public Works Department is authorized and directed to post
appropriate signage consistent with the provisions of this ordinance.
Section 4. This ordinance shall take effect and be in full force five (5) days after
its passage, approval and publication.
