ORD 96-42 LAND CLEARING FIRESORDINANCE NO. 96-42
AN ORDINANCE of the City of Bainbridge Island, Washington,
establishing special rules for !and clearing fires for the
period of September 20, 1996 to October 11, 1996 to address
the burn ban issued July 24, 1996, amending Section 15.04.110(C)3
of the Bainbridge Island Municipal Code from September 20, 1996
to October 11, 1996, and declaring an emergency.
WHEREAS, the Bainbridge Island Municipal Code (15.04.110(C)3 allows only (1)
land clearing fire of no larger than 10 feet in any dimension per tax lot; and
WHEREAS, the Bainbridge Island Fire District has adopted policies which allow up
to two (2) fires bnrning per acre or three (3) burning fires per parcel of up to fifty (50) feet
iu diameter; and
WHEREAS, the City believes it is necessary to allow individuals in possession of
building or grading permits who were prohibited from couducting land clearing fires due
to the Countywide burning bail issued July 24, 1996, to conduct land clearing fires in
compliance with this ordinance and the policies adopted by the Bainbridge Island Fire
District consistcut with this ordinance;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Bainbridge Island, Washiugton, as follows:
Section 1. Those individuals in possessiou of an approved building or grading pernfit
who were prohibited from condncting !and clearing fires dne to the Countywide burn ban
issued July 24, 1996, may conduct no more than one land cleariug fire np to fifty (50) feet
in diameter per acre at auy time from September 20, 1996 to October 11, 1996. The fires
shall furl. her be couducted pursuant to a burn permit issued by the Bainbridge Island Fire
District and shall meet all burning conditions and policies of the Bainbridge Island Fire
District that are consistent with this section.
Section 2. Section 1, of this ordinance shall amend Section 15.04,110(C)3 of the
Bainbridge Island Mnuicipal Code from September 20, 1996 to October 11, 1996.
Thereafter, the previous language of Section 15.04.110(C)3 shall be reinstated.
Sectiou 3. Effective Date. This ordinance, passed by a majority plus one of the
whole nmmbership of lhe City Council as a public emergency necessary for the protection
of the public health, safety or welfare, shall be effective immediately npon its passage.
