ORD 96-41 BREMERTON-KITSAP COUNTY HEALTH DISTRICTORDINANCE NO. 96-41 AN ORDINANCE of the City of Bainbridge Island, Washington, regarding lhe Bremerton-Kitsap County Health District. WHEREAS, the Bremerton-Kitsap County Health District was created pursuant to RCW 70.46.46 et.seq by resolution oil November 3, 1947; and WHEREAS, RCW 70.46.031 establishes that the Bremerlon-Kitsap County Health Districl may remain in exislence; and WHEREAS, the Board of Kitsap County Conunissioners desire to continue to participate in the Bremerton-Kilsap County Health District; and WHEREAS, the legislative authorities for the Cities ol' Bainbridge Island, Bremerlon, Porl Orchard, and Poulsbo desire to continue to !~arlicipate in tile Bremerton- Kitsap County Heallh District; NOW, THEREFORE, IT IS HEREBY ORDAINED AS FOLLOWS: Seelion 1. Definitions. The following terms are defined as follows: A. Board of lteallh -- the Boai'd of Health for the Bremerton-Kilsap County Health Dish-tel. B. Cities -- lhe cities of Bainbridge Island, Breme~qon, Porl Orchard and Poulsbo. C. Counly -- Kitsap County. D. HealIll District -- lhe territory within the cities and within the county which provides public heallh services to persons. E. ttealth Officer-- the legally qualified physician who has been al~pointed by the Board of Heallh. Section 2. Organization established. TIle existence of tile Health District as a separate entity is reaffirmed in accordance witIt RCW 70.46.46 et.seq. Seelion 3. Powers and ditties o1' tile fleallh Dislricl. Tile Health District shall provide public health services to the residents of and on bellall' of the County and Cities. in addition, lhe lteallh District is vested with all the powers to perform all duties as set forth in RCW 70.05 et.scq. and RCW 70.46 et.seq. Seclion 4. Board of llealth established. The Board of Health is hereby reaffirmed and eslablished. Section 5. Control by lhe Board of Health. The control, direction and managentent of the HealIll District are herehy vested in the Boai'd of HealIll. Section 6. Cmnposition of tile Board of Health. The Board of Health shall be composed of nine (9) persoils as follows: (1) the three (3) County Commissioners; (2) the Mayor, City Council President and one at-large Council nlemher of Bremerton; (3) tile Mayors of Bainhridge Island, Port Orchard and Poulsbo. Section 7. Conduct of business by the Board of Health. A. Meetings. The business and other matters which come before the Board of Health shall be transacted at open, public meetings. Meetings may be scheduled at regular times or may be called as necessary. B. Quorum. Five (5) members of the Board of Health shall constitute a quorum and business may be transacted by a majority vote. C. Election. At the first meeting of each calendar year the Board of Health shall elect one of its members chairperson and another vice chairperson. Each shall serve for the balance of the calendar year or until successors are elected. D. Minutes. The Health Officer or someone designated by him or her shall keep the minutes of all meetings. E. Rules. The Board of Health meetings shall he conducted in accordance with Robert's Rules of Order. Section 8. Health Officer. The Boai'd of HealIll shall appoint a Healill Officer who shall organize, administrate and operate the Heallh District oil a day-to-day basis. The Healill Officer shall serve at the pleasure of the Boai'd of HealIll. Section 9. Powers and tinties of Health Officer. The Health Officer shall: A. Enforce iml~lic health slattiles of the state, rules of the state board of health and the scc,'etary ol' health, and all local rules and regulations regarding public health. B. Take soch action as is necessary to maintain tile health and sanitation supervision over tile County and Cities. C. Control and prevent tile spread of any dangerous, contagious or infectious diseases. D. disability E. F. Inform lhe public as 1o tile causes, nalure, and prevention of disease and and preservation, promotion and improvement of health. Prevent, control or abate nuisances which are detrimental to the pul~lic health. Attend all conferences called by the secretary of health or his or her authorized representative. G. Collect such fees as arc eslahlished by the state board of health or the Board of ileallh for the issuance or renewal of licenses or permits or such other fees as may be authorized. ti. Inspect, as necessary, expansion or modifications of existing public water systems, and the construction of new public water systems, to assure that the expansion, modification, or construction conforms to system design and plans. !. Take such measures as he or she deems necessary in order to promote lhe puhlic health, to pa~qicipate in the estahlishment of health educational or training activities, and to authorize the attendance of employees of the Health District or individuals engaged in conmmnily health programs related to or pa~q of the programs of the Health District. Seclion 10. Budget. A. Submittal of basic budget~ Prior to tile expiration of each calendar year, tile Health Officer shall submit a proposed basis budgel to the budget director of Kitsap County. The proposed basis budget shall include expenditures firetied by: Kitsap County's conlribution, the motor vehicle excise tax amount pursuant to RCW 82.44.110(1)(1), user fees. granls, gills and any other available revenue. Kitsap County's contribution to the basic budget shall be consistent with budgetary guidelines issued by lhe Kitsap County budget direclor. Thereafler, the proposed basic budget shall be submitted to the Board of HealIll after the County hurlgel department has verified the County's contribution in accordance with the guidelines. B. Adoption. The Board of Health shall adopt a basic budget each calendar year. C. Submittal of supplemenial budget. If the Heallh Officer determines that supplemental funding is required, he or she will simultaneously subnlit a supplemental proposal with the basic budget proposal. The proposed supplemental budget shall be submitted to the budget director of the County and of each City for his or her recommendation. Thereafter, the proposed supplemenial budget, together wilh the recommendations o1' each budget director, shall be submitted to the Board of ltealth. D. Adoption. The Board of !lealth shall adopt a supplemental budget, if a!~plicable, each calendar yeas'. Approval shall require unanimous vote frol:i the members conl ribuling l'unds to the supplemental budget. E. Special prqiects. The County or any City, or any combination therefi~r, may volunlarily fund a special project of lhe Health District. Section I 1. Funding. A. Basic Budget. The annual basic budget amount of the Health l)islrict shall be funded by the Counly's contribution from the general fund, receipt of grants, gifts, and the !}ttl~lic health account. which is created from a po~qion of the Cities' motor vehicle excise tax alld distrilnflcd by the state treasurer. B. Supl~lemental Budget. The supplemental budget amount o1' the Heallh District not funded in the basic budget shall be funded by assessments from Cities. The assessment amount for each oily shall be thai amount which is propo:qionate to the population of that city, and ihal percentage is lhen multiplied by the budget amount. The County, in il's discretion, may agree to pa:qicipale in the binding of the supplen:ental budget. In the event lhal lhe Counly does agree to pa:qicipale, the assessment anaount for the county shall be that amount which is propo:qionate Io the population of lhe unincorporated po~ion of the County and thai percenlage is then multiplied by the bt:dgel amount. Population figttres utilized shall be the lalesl figures available from the Bureau of Census as updated periodically by lhc stale departmenl of heallh or olher official source. C. Special prqiects. Funding for special projects may be obtained from any entity agreeing to conmill t'unds. The County and Cities shall not have the authority to commit funds of another chilly. Seclion 12. Fund esla!~lished. Moneys received and collected on behalf of the lleallh Dislricl shall be deposited in a fund known as the lleallh District fund maintained by the County's treasurer. Expenditures by the Health District shall be made from this fund. Section 13. Construction. This ordinance shall be liberally construed to secure the public health, s~fely m~d welfm'e, and the rule of sh'icl construction shall have no application. Section 14. Severability. If any porlion of this ordinance or its application to any person or circumstance is held invalid, the remainder or application to other persons or circumstances shall not be affecled. Section 15. Effective date. This ordinance shall become effective, the County's Resolution No. 20%1996 "Resohflion of Intent to Withdraw Membership from the Bremerlon-Kitsap County Health District" shall become null and void, and the Health District shall conlint,e in existence when County and Cilies each enacl an ordinance similar in substance to this, or five (5) days after approval, posting and publication of lhis ordinance or whichever comes last. Section 16. Repealer. The 1947 Resolution and Inletlocal Agreements passed by Cilies and County regarding lhe tleallh Dish-icl are hereby repealed.
