ORDINANCE NO. 96 - 34
AN ORDINANCE of the City of Bainbridge Island, Washington,
relating to hearing examiners, and amending Sections 2.38.020 and
2.38.030 of the Bainbridge Island Municipal Code.
WHEREAS, the City desires to amend the rules governing hearing examinex conduct,
removal and term of offtee; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASKINGTON
DO ORDAIN as follows:
S~li0..n...1.. Seefen 2,38,020 of the Bainbridge Island Municipal Code is amended as
follows:
The hearing examiner shall be appointed by the mayor, confined by the city
council, and shall serve for a term of [four] 1~,o years. The appointed hearing
examiner shall be removed only LLI upon conviction of [misconduct or
malfon~nnoo in 0ffice] a gross misdemeanor or felony. (2) [o~] because of physical
or mental disability rendering the hearkng examiner incapable of pexforming the
duties of the office, (.3) upon_conviction of a.yiolation of Section 2,38.030 of this
code, or (4) upqn conviction of a violation of Chapter 42.23 RCW. the violation
of which shall,.c, Qn.a~9,1te a misdemeanor under this code. The duties of the
hearing examiner shall be as established by the city souneff by ordinance.
Section 2- Section 2.38.030 of the Bahbridge Island Municipal Code is amended as
follows:
No person shall.attempt to influence the hearing examiner in the performance of
duties. The hearing examiner shall not discuss the merits of any [pcnding] case
[with any other person cxcept at the public heating] consi~tered.. by_the hearing
examiner until alLcity review and court appeals have been concluded and a ~.n_gl
~JeCision. has .b~n rendered. Any violation of this provision shall be deemed a
misdemeanor and may be punished by the provisions set out in BIMC Chapter
1.24.
Section 3. This: ordinance shall take effect and shall be in force five days from and after
its passage, approval, and publication.
