ORD 96-24 PARKINGORDINANCE NO. 96-24 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to parking; amending Section 10.08.070, Section 10.08.220 and Paragraph A of Section 10.08.250 of the Bainbridge Island Municipal Code. WHEREAS, the City has established "Restricted Carpool" parking spaces at the City's ferry terminal parking lot to encourage a reduction in vehicle usage in an effort to support environmental considerations; and WHEREAS, the City has reserved approximately 80 carpool spaces, and offers a carpool parking permit at a rate lower than the regular daily rate; and WHEREAS, routine and special police department surveillance has indicated that carpool parking permit holders violate BIMC 10.08.070 when parking in the carpool spaces; and WHEREAS, the City has determined that it is in the best interests of the City to reduce the number of persons constituting a carpool from three individuals to two adults; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN as follows: Section 1. to read as follows: Section 10.08.070 of the Bainbridge Island Municipal Code is amended In areas designated "Restricted Carpool," no vehicle shall be parked before 8:45 a.m. on Monday through Friday, unless: A. A valid carpool permit issued by the city is displayed on the inside lower left-hand corner of the windshield in such a manner that the carpool permit number and expiration date are visible from the outside of the vehicle; B. The car is parked in the space assigned to the carpool permit; and C. Two or more adults are in the car at the time it is parked in the assigned space. If the carpool is reduced to less than two adults, the car shall be parked in a non-carpool space and pay the appropriate parking fee for that non-carpool space. For purposes of this section, an adult is a person sixteen years of age or older. DOCS\94700\106\0113997.02 - 1 - Section 2. Section 10.08.220 of the Bainbridge Island Municipal Code is amended to read as follows: A. The City shall revoke the carpool parking privileges of any carpool parking permit holder determined to have duplicated or falsified a carpool parking permit. B. The City shall revoke for a period of one year the carpool parking privileges of any carpool parking permit holder who is determined to have violated the provisions of Section 10.08.070 above on three or more occasions. C. If, as a result of the revocations described in this section, the number of members in a carpool group falls below two, the carpool group will be responsible for substituting a new carpool member. This new carpool member must be registered in the manner required by the City prior to the further exercise by the carpool group members of their carpool permit privileges. Section 3. Paragraph A of Section 10.08.250 of the Bainbridge Island Municipal Code is amended to read as follows: A. It shall be a traffic infraction for any person to permit or allow a motor vehicle to stop, stand or be parked in violation of any of the provisions of this chapter. The monetary penalty for violation of any of the provisions of this chapter shall be $10.00 for each such violation; except (1) if any person shall park a vehicle in a parking place provided on private or public property reserved for physically disabled persons without a special license plate, valid card, decal or other official mark, the monetary penalty shall be $175.00 for each such violation, and (2) if any carpool permit holder violates any of the provisions of BIMC 10.08.070, the monetary penalty for the first violation shall be $50.00, and the monetary penalty for the second and all subsequent violations shall be $100.00. In addition to monetary penalties, a carpool permit holder violating the provisions of BIMC 10.08.070 on three or more occasions shall have his or her carpool parking privileges revoked for a period of one year in accordance with BIMC 10.08.220B. Notice of traffic infraction shall be affixed in a conspicuous place to the motor vehicle stopping, standing, or parking in violation of the provisions of this chapter and shall be in the form approved by the administrator for the courts. All monetary penalties shall be paid to the municipal court of the City. Section 4. This ordinance shall take effect and be in force on and after August 1, 1996.
