ORDNANCE
AN ORDINANCE of the City of Bainbridge Island, Ws_shington,
relating to parade permits; amending Sections 12.06.010,
12.06.020, 12.06.030 and 12.06.050 of the Bainbridge Isl_a_nd
Municipal Code, and declaring an emergency.
WHEREAS, on March 27, 1996, a lawsuit was ftlat against the City by certain
individuals relating to the City's paxade pgnnit ordinance; and
WHEREAS, the City Council has determined it is in the best interests of tl~ City to
amend certain portions of its parade permit ordinance; now, thea'~fore

DO ORDAIN as follow. s:
Section 1. Section 12.06.010 of the Bainbridge Island Municipal Code is amended to
read as follows:
Except as Frovided in Section 12.06.020, it is unlawful for any pexson to
paxade, within, over or across any public street, fight-of-way, park or other
public place without first having obtainfl a parade permit from the chigf of po. Liee
or other designated employee of the police department ff the chief of police is
unavailable. For the purposes of this chapter, a 'parade' shall include a~y
parade, march, domonstration, piekoting or procession of any kind. is a match
or procession. A parade may include floats, motor vehicles, or animals.
Picketing shall not constitute a parade under this cha~pter.
Section 2. Section 12.06.020 of the Bainbridge Island MUnic~12ml Code is amended to read
as fogows:
A permit: slnall not be required fo:r funeral pxocessions._ or p~ados of the
military forth of the Unitod States of Amotioa or of the state of Washington..
Section 3. Section 12.06.030 of the Bainb~dgc Island Municipal Code is ~'nendexl to
read as follows:
A. Any person or orga~intion desiring to parade within, over or across
any public street~ right-of-way, park or other public place, shall first apply to the
chief of police or other designated employee of the police department for a parade
permit. The application shall state:

1. The identity of the applicant and the'addxe~ and phone number
of a responsible individual;
2. The requesWA pande route;
3, The time and date of said ~e parade;
4. The anticipamd attendance at the ~ parade as well as an
estima~ of the length of :aid the parade and the time that it will tak~ to pass any
designated spot along the rour~; and
5. A description of the floats, motor vehicles or animals, ff any,
to be used in ~ t~ parade.
B. Such application shall be in writing and filed with the chief of police
or other designated employee of the noli.ce department not less than 36 hours
prior to the start of saki the parade. The 36 hour time limit for written
notification may.be waived if, at the time the application is submitted. the chief
of police or other designsled employee of the police department anticipates being
able to make rP~.~onable preparations for the parade within less time than 36
hours.
Section 4. Seelion 12.06.050 of the Bainbridge Island Municipal Code is amended to
re_ad as follows:
No permit shall be denied by the chief of police or other designated
employee of the police departme. at except upon the following grounds:
A. The desired parade route conflicts with another parade for which a
permit has already been issued; or
B. The proposed route would unreasonably prevent or block the provision
of emergency services within the city of Bainbf, dgo hland; or
C. The parade would unduly disturb the convenience of the public in the
use of the public streets and/or sidewalks; or
D. The conduct of the pande is reasonably likely to cause injury to
persons or propexty or to provolta disorderly conduct.
In the event that a permit is denied for any of the reasons shown in
subsections A through D of this section, the chief of police or other designated
_employee of the police dep~rtment shall work with the applicant in order to find
an unencumbered time or date suitable to the applicant and shall suggest alternate
roums which would not unduly prevent or block the provision of senric~.

Section 5. Effective Dat~. This ordinance, passed by a majority plus one of the whole
m~mbexship of the city council as a public emergency necessary for the protection of tho public
health, safety or welfare, shall be effective immediately upon its passage.
