ORD 96-15 PARK & RIDE LOTSORDINANCE NO. 96-15 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to park-and-ride lots and amending Chapters 18.12.030, 18.15.030, 18.21.030, 18.24.030, 18.27.030, 18.30.030, 18.33.030, 18.36.030, 18.57.030, 18.66.030, 18.69.030, 18.72.030, 18.75.030 of the Bainbridge Island Municipal Code and adding new chapters, 18.06.XXX and 18.06.XXX. WHEREAS, the City adopted a Comprehensive Plan on September 1, 1994, which contains a Transportation Element that establishes goals and policies that encourage the use of transit over automobiles and also encourages small neighborhood park-and-ride lots in the City; and WHEREAS, in accordance with RCW36.70A, the Growth Management Act that requires that development regulations be adopted that implement the Plan; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows: Section 1. New Chapter. There is added to Title 18 of the Bainbridge Island Municipal Code a new chapter, 18.06.XXX, entitled "Park and Ride Lot" to read as follows: 18.06.XXX Park and Ride Lot. "Park and Ride Lot" means an area intended to accommodate parked vehicles during normal commuting hours, usually 5 AM to 8 PM, Monday through Friday, where commuters park their vehicles and continue travel to another destination via public transit or carpool or vanpool or bicycle. Park and Ride Lots are developed in accordance with Chapter 18.81, Parking and Access Requirements, and Chapter 18.XX, Landscape Requirements. Section 2. New Chapter. There is added to title 18 of the Bainbridge Island Municipal Code a new chapter, 18.06.XXX, entitled "Shared-use Park and Ride Lot" to read as follows: 18.06.XX Shared-use Park and Ride Lot. "Shared-use Park and Ride Lot" means a parking lot that was originally developed for a limited, non-residential use, such as a church or theater, and serves the same function as a Park-and-Ride Lot, 18.06.XXX but is restricted for use by commuters Monday through Friday only, usually from 5 AM to 8 PM. A Shared-use Park-and-ride lot requires no expansion of existing parking area or number of stalls or any other development beyond maintenance, signage and striping normally conducted by Kitsap Transit for this purpose Section 3. Chapter 18.12.030 is the Bainbridge Island Municipal Code is amended as follows: 18.12.030 Conditional uses. Conditional uses are: A. Bed and breakfast establishments; B. Child day care centers; C. Major home occupations; D. Public and private utility buildings and structures; E. Senior citizen housing projects utilizing the bonus densities set forth in this chapter under bonus densities allowed, Section 18.12.080. (Ord. 95-07 § 8, 1995; Ord. 92-08 § 2, 1992 F. Shared-use park-and-ride lots; Section 4. Chapter 18.15.030 is the Bainbridge Island Municipal Code is amended as follows: 18.15.030 Conditional uses. Conditional uses are: A. Bed and breakfast establishments; B. Child day care centers; C. Educational, cultural, governmental, religious or health care facilities; D. Major home occupations; E. Public and private utility buildings and structures; F. Senior citizen housing projects utilizing the bonus densities set forth in this title under Section 18.12.080, except that a minimum of 3000 square feet of lot area per unit shall be required and the parking requirement shall not be less than one space per unit. Conditional uses are: A. Agriculture; B. Child day care centers; C. Educational, cultural, governmental, religious or health care facilities; D. Major home occupations; Park & Ride Ordinance - 4/4/96 E. Public and private utility buildings and structures; F. Public parks and playgrounds. (Ord. 92-08 § 2, 1992) G. Shared-use park-and-ride lots: Section 6. Chapter 18.24.030 is the Bainbridge Island Municipal Code is amended as follows: 18.24.030 Conditional uses. Conditional uses are: A. Agriculture; B. Bed and breakfast establishments; C. Child day care centers; D. Educational, cultural, governmental, religious or health care facilities; E. Major home occupations; F. Public and private utility buildings and structures; G. Public parks and playgrounds. (Ord. 92-08 § 2, 1992) H. Shared-use park-and-ride lots: Section 7. Chapter 18.27.030 is the Bainbridge Island Municipal Code is amended as follows: 18.27.030 Conditional uses. Conditional uses are: A. Agriculture and accessory uses except agricultural processing; B. Bed and breakfast establishments; C. Child day care centers; D. Educational, cultural, governmental, religious or health care facilities; E. Major home occupations; F. Public and private utility buildings and structures; G. Public parks and playgrounds. (Ord. 92-08 § 2, 1992) H. Shared-use park-and-fide lots: Section 8. Chapter 18.30.030 is the Bainbridge Island Municipal Code is amended as follows: 18.30,030 Conditional uses. Conditional uses are: A. Agricultural processing; B. Bed and breakfast establishments; C. Cemeteries; Park & Ride Ordinance - 4/4/96 D. Child day care centers; E. Educational, cultural, governmental, religious or health care facilities; F. Group health facilities; G. Major home occupations; H. Marinas/boat rental facilities; I. Mining and quarrying; J. Multifamily dwellings; K. Open-air sales for garden supplies; L. Park-and-ride lots; M. Public and private utility buildings and structures. N. Shared-use park-and-ride lots; Section 9. Chapter 18.33.030 is the Bainbridge Island Municipal Code is amended as follows: 18.33.030 Conditional uses. Conditional uses are: A. Bed and breakfast establishments; B. Cemeteries; C. Child day care centers provided, the subject property has a minimum lot area of one acre; D. Educational, cultural, governmental, religious or health care facilities; E. Group health facilities; F. Mining and quarrying; G. Multiple-family dwellings with additional criteria of a 25-foot perimeter natural vegetative easement and interior open space; H. Open-air sales for garden supplies; I. Park-and-ride lots: J_. t~. Public and private utility buildings and structures; K__~. ~ Recycling centers; provided that the subject property has a minimum lot area of one acre and has frontage on an arterial. L. Shared-use park-and-ride lots: Section 10. Chapter 18.36.030 is the Bainbridge Island Municipal Code is amended as follows: 18.36.030 Conditional uses. Conditional uses are: A. Bed and breakfast establishments; B. Cemeteries; C. Day care centers; provided that the subject property has a minimum lot area of two and one-half acres; D. Educational, cultural, governmental, religious or health care facilities; Park & Ride O~dinance - 4/4/96 E. Group health facilities; F. Major home occupations; G. Mining and quarrying; H. Multifamily dwellings; I. Open-air sales for garden supplies', J. Park-and-fide lots; K. Public and private utility buildings and structures; L. Recycling centers; provided that the subject property has a minimum lot area of two and one-half acres. M. Shared-use park-and-ride lots; Section 11. Chapter 18.57.030 is the Bainbridge Island Municipal Code is amended as follows: 18.57.030 Conditional uses. Conditional uses are: A. Public and private utility buildings and structures; B. Hazardous substance handling incidental to permitted uses; C. Other uses deemed likely to cause a nuisance if not otherwise controlled, except formula take-out food restaurants are not permitted; D. Senior citizen housing projects utilizing the bonus densities set forth in Section 18.12.080, according to the density regulations of Chapter 18.15. (Ord. 92-08 § 2, 1992) E. Shared-use park-and-ride lots~ Section 12. Chapter 18.66.030 is the Bainbridge Island Municipal Code is amended as follows: 18.66.030 Conditional uses. Conditional uses are: A. Commercial/residential mixed use developments provided that the residential units are located above the ground floor and are at a density not to exceed that of the most intense residential zone adjacent to the subject property; B. Hazardous substances handling incidental to permitted uses; C. Private utility buildings and structures; D. Retail buildings of a footprint greater than 5000 square feet but less than 10,000 square feet; E. Storage facilities provided no outdoor storage is visible from adjoining properties and public fights-of-way. (Ord. 92-08 § 2, 1992) F. Shared-use park-and-ride lots: Park & Ride Ordinance - 4/4/96 Section 13. Chapter 18.69.030 is the Bainbridge Island Municipal Code is amended as follows: 18.69.030 Conditional uses. Conditional uses are: A. Commercial/residential mixed use developments provided the residential units are located above the ground floor and are at a density not to exceed that of the most intense residential zone adjacent to the subject property; B. Hazardous substances handling incidental to permitted uses; C. Private utility buildings and structures; D. Storage facilities provided no outdoor storage is visible from adjoining properties and public fights-of-way. (Ord. 92-08 § 2, 1992) E. Shared-use park-and-ride lots: Section 14. Chapter 18.72.030 is the Bainbridge Island Municipal Code is amended as follows: 18.72.030 Conditional uses. Conditional uses are: A. On-site treatment and storage of hazardous substances; B. Outdoor storage; C. Public and private utility buildings and structures; D. Retail sales of items manufactured on site; provided that not more than two such sales shall be allowed each calendar year, each sales event shall last not more than two consecutive days, and cumulative effects of area businesses conducting similar sales shall be considered by the hearing examiner; E. Warehouses, commercial moving and freight terminals; F. Other uses deemed likely to cause a nuisance if not otherwise controlled, except that formula take-out food restaurants are not permitted. Conditional uses are: A. All manufacturing uses; B. Outdoor storage; C. Public and private utility buildings; D. Any use deemed likely to cause a nuisance if not otherwise controlled; Park & Ride Ordinance - 4/4/96 E. Formula take-out food restaurants are not permitted; F.
