RESOLUTION NO. 2023 – 06
A RESOLUTION of the City of Bainbridge Island, Washington, adopting a
certain Transportation Impact Fee base rate as allowed under RCW 82.82.060.
WHEREAS, the City of Bainbridge Island currently charges transportation impact fees
for new development growth as a revenue source to fund transportation improvement projects
based on a 2015 rate study and Capital Improvement Plan (CIP) transportation improvement
project list; and
WHEREAS, several eligible projects have been completed from the CIP list that were
constructed utilizing collected transportation impact fees; and
WHEREAS, the City’s Sustainable Transportation Plan (STP) identified updating the
City’s transportation impact fees as a key task for maintaining the plan’s potential revenue
sources; and
WHEREAS, a new fee rate study was needed that incorporates STP projects and new
CIP projects; and
WHEREAS, the current transportation impact fees charged by the City of Bainbridge
Island are some of the lowest in the Kitsap peninsula region; and
WHEREAS, the average transportation impact fee base rate for Western Washington in
2023 is $5,362 per PM peak hour vehicle or person trip; and
WHEREAS, the current base rate charged by the city per vehicle trip is $1,811 per PM
peak hour vehicle trip;
WHEREAS, the City desires to update the transportation impact fee program to support
multi-modal transportation projects in the STP. The update to the program will shift focus from
setting the fee based on growth in vehicle trips created by new development to growth in person
trips created by new development; and
WHEREAS, the consultant, Fehr & Peers, prepared an updated Transportation Impact
Fee Study, dated September 2023.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. In accordance with RCW 82.82.060, the per person trip base rate shall be
established at $5,000 to calculate transportation impact fees and be administered in accordance
with BIMC 15.30 Transportation Impact Fees.
Section 2. The transportation impact fee rate schedule is to be updated with the adopted
base rate in accordance with BIMC 15.30.200 and made effective January 1, 2024.

Section 3. In accordance with BIMC 15.30 the base rate will be automatically adjusted
for inflation bi-annually to reflect changes in project costs due to industry trends.
Section 4. Severability. Should any section, paragraph, sentence, clause, or phrase of this
ordinance, or its application to any person or circumstance, be declared unconstitutional or
otherwise invalid for any reason, or should any portion of this ordinance be preempted by state
or federal law or regulation, such decision or preemption shall not affect the validity of the
remaining portions of this ordinance or its application to other persons or circumstances.
Section 5. Effective Date. This resolution shall take effect and be in full force
immediately upon its passage.
