ORD 97-28 LYNWOOD CENTER ZONING MAPORDINANCE NO. 97-28
AND ORDINANCE of the City of Bainbridge Island,
Washington, relating to the Lynwood Center Special
Planning Area, amending Chapters 18.66.070 and
18.30.040 of the Bainbridge Island Municipal Code and
amending the Official Zoning Map.
and
WHEREAS, the City adopted a Comprehensive Plan on September 1, 1994, as amended;
WHEREAS, the City undertook the Lynwood Center Special Planning Area process as
designated in Policy NSC 1.2 of the Land Use Element of the Comprehensive Plan and which
process is set out in BIMC 18.115, Special Planning Area Process; and
WHEREAS, after extensive deliberations and two public meetings, the Lynwood Center
Special Planning Area Report and Final Recommendations was prepared dated, January 3, 1997;
and
WHEREAS, the Lynwood Center Special Planning Area process developed specific
recommendations for increased density allowances within the Special Planning Area which, in
the aggregate, provides for a limited increase in density within the entire Special Planning Area;
and
WHEREAS, implementation of the Lynwood Center Report and Final Recommendations
required amendments to the Comprehensive Plan which were adopted by Ordinance 97-16 on
June 5, 1997, in accordance with BIMC 18.115.080 and BIMC 18.117; and
WHEREAS, in accordance with RCW 36.70A, the Growth Management Act,
development regulations must be adopted that implement the Comprehensive Plan; now,
therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO
ORDAIN, as follows:
Section 1. A new section 18.66.070E is added to the Bainbridge Island Municipal Code, as
follows:
18.66.070 Density Increases
Density may be increased as follows:
A. 3 units per acre with the provision of Transfer of Development Rights (TDRs), in
accordance with Chapter 18.37; or
B. 3 units per acre with the provision of affordable housing, in accordance with the
provisions of Chapter 18.90; or

5 units per acre, in accordance with Chapter 18.20, with the provisions of TDRs and
public sewer and water; or
5 units per acre, in accordance with Chapter 18.20, the provision of affordable
housing in accordance with Chapter 18.90, and public sewer and water; or
Up to 12 units per acre for those specific parcels located in Lynwood Center and so
designated on the Land Use map as NSC/R-12 for the Lynwood Center Special
Plannin~ Area, in accordance with the following provisions:
1. The development is commercial/residential mixed use with the residential units
located above the ~round floor;
2. Public sewer and water are provided;
3. The requirements of 18.66.020, 18.66.030, 18.66.040, 18.66.050, and 18.66.060
and 18.90 are met;
4. A community center is constructed that is of similar style and quality to the entire
development, is no less than 2000 square feet, provides kitchen facilities, public
restrooms and outside access. The community center is to be used primarily for
community functions.
Section 2. Section 18.30.040 of the Bainbridge Island Municipal Code is amended as follows:
18.30.040 Lot area and density.
A. The density shall be two units a~ per acre.
B. The base density for that parcel in the Lynwood Center Special Planning Area
designated as R-2* is two (2) units per acre but may be increased up to 3 units per
acre provided that a public access easement is granted for that portion of the parcel
that lies to the south of Point White Drive along the waters of Rich PassaRe.
C.B. The minimum lot area shall be 20,000 square feet, except as provided in section B
above.
D.C. When a short plat or subdivision of land is proposed where all proposed lots meet
the minimum lot area in paragraph ]~ C but do not meet the density requirement in
paragraph A, the short plat or subdivision may be approved containing no more than
one more lot than would be allowed by the underlying density provided that all lots
meet the minimum lot area.
Section 3. The locations and boundaries of the Lynwood Center Special Planning Area, the
NSC/R-12 and the provisional R-2* areas as shown the comprehensive land use map, as
amended, shall be shown on the map entitled "City of Bainbridge Island Official Zoning Map",
which is amended hereby.
Section 4. This ordinance shall take effect and be in force five days from and after its passage,
approval and publication as required by law.
