RES 2006-30 POLICE BOATRESOLUTION NO. 2006-30 A RESOLUTION authorizing the purchase of a high definition imaging sonar and remotely operated underwater vehicle (ROV) system from Blue View Technologies, Inc. and VideoRay LLC, respectively, to be used to enhance public safety and law enforcement operations for a purchase price not to exceed $65,000 (plus sales tax) as a sole source purchase without calling for bids, and further directing the Mayor to execute all appropriate and necessary documents to complete the purchase and transaction. WHEREAS, BIMC 3.72.020(A) states that no informal or formal bid process is required for the purchase of supplies, materials, or equipment that are not part of a public works project; and WHEREAS, BIMC 3.72.020(B) states that staff "shall continue on an ongoing basis to obtain the lowest practical price for supplies, materials, and equipment purchased under this section"; and WHEREAS, RCW 39.04.280(1), RCW 35.23.352(9) and state law in general recognize a "sole source purchase" exception from competitive bidding requirements when, due to the uniqueness of the product to be purchased and the fact that there is only one source, it would be futile to utilize a competitive bidding process for such product; and WHEREAS, the Bainbridge Island Police Department requires the purchase of high definition imaging sonar and remotely operated underwater vehicle equipment to be utilized by the police marine patrol program to enhance police officer safety and law enforcement operations; and WHEREAS, for operational reasons, the equipment must have certain key features, including the following: • The system must allow the operator to place distance between themselves and a potential threat; • The system must be rugged, reliable and easy to use; • The system must be compact and easily stored or transported; • The system must be able to cover a large area quickly and completely; • The system must be able to be used in a wide variety of applications; • The system must be affordable; • The system must be able to record events for documentary purposes; • The system must be a proven combination of technologies; and WHEREAS, during most of 2005, personnel from the Bainbridge Island Police Department conducted extensive research regarding available high definition imaging sonar and ROV systems and concluded that only one system available through two manufacturers (Blue View Technologies, Inc., who make high definition imaging sonar, and VideoRay LLC who make affordable micro -sized remotely operated underwater vehicles) would satisfy said requirements and criteria; and (Ik)res/sole source/audio-video recording systeru/poIice/ pm WHEREAS, Blue View Technologies, Inc. and VideoRay LLC are the only source for said system and are willing to sell the system to the City $60,566.56 plus sales tax; and WHEREAS, the City Council finds it would be futile to call for bids regarding the described equipment since only the high definition imaging sonar and ROV system available from Blue View Technologies, Inc. and VideoRay LLC, respectively, will satisfy the stated requirements and criteria and Blue View Technologies, Inc. and VideoRay LLC are the only source for said equipment; and WHEREAS, the City Council finds that it is in the best interest of the City to authorize purchase of the high definition imaging sonar and ROV combination from Blue View Technologies, Inc. and VideoRay LLC as a sole source purchase without calling for bids, now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: 1. The Mayor is hereby authorized and directed to purchase the high definition imaging sonar and ROV combination as a sole source purchase without calling for bids from Blue View Technologies, Inc. and VideoRay LLC to be used to enhance public safety and law enforcement operations for a purchase price not to exceed $65,000 plus sales tax. 2. The Mayor is further directed to execute all appropriate and necessary documents to complete the purchase and transaction. The final form of said documents shall be reviewed and approved by the City Attorney or his designee. PASSED BY THE CITY COUNCIL this 14"' day of June, 2006.
