Resolution No. 2023-10 Relating to Revision of Certain City Fees (Approved 121223)Page 1 of 2 RESOLUTION NO. 2023-10 A RESOLUTION of the City of Bainbridge Island, Washington, updating certain fees in the City’s Fee Schedule. WHEREAS, RCW 82.02.020 authorizes the collection of reasonable fees to cover the costs to the City for certain activities; and WHEREAS, the City of Bainbridge Island periodically updates the Fee Schedule to reflect City Council actions and the actual cost to the City of various services in accordance with state law; and WHEREAS, the City periodically corrects errors in the fee schedule and makes certain changes for clarity; and WHEREAS, on March 22, 2022, the City Council enacted Ordinance No. 2022-05 relating to the process of updating certain fees and charges, amending and retitling BIMC 15.04.050, expressly authorizing the City Council to update fees and charges by resolution, and providing for an annual adjustment of all City fees based on the U.S. Consumer Price Index (“CPI”); and WHEREAS, Section 4 of Ordinance No. 2022-05 and as amended via Ordinance No. 2022-15 specifies that all fees or charges levied by the City shall be subject to adjustment each year equal to the annual percentage increase in the United States Consumer Price Index, Seattle area (CIP-U), for June of the preceding year as shown in the release from the Bureau of Labor Statistics; except as specified in BIMC 15.30.140 for transportation impact fees, unless the City Council determines by December 31st of any year that the adjustment shall be another amount or shall not occur for the next year; and WHEREAS, on May 23, 2023, the City Council enacted Ordinance No. 2023-16 updating certain Water and Sewer Utility fees in the City’s Fee Schedule, revising the City’s Sewer monthly residential Category 1, Single-Family and Category 2, Multiple-Dwelling billing methodology, and revising Bainbridge Island Municipal Code Section 13.16.040.A including for the years 2024 and 2025; and WHEREAS, the City desires to update the City’s Fee Schedule to reflect the corrections and to clarify certain provisions, and those revisions are being made to the Fee Schedule that was previously revised by Resolution No. 2022-06, Resolution No. 2022-22, Resolution No. 2022-27, Ordinance No, 2022-05, Ordinance No. 2022-15 and Ordinance No. 2023-16. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The fee changes identified in Exhibit A of this Resolution, attached hereto and incorporated by reference, shall take effect January 1, 2024. Page 2 of 2 Section 2. Severability. If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. Section 3. Should any section, paragraph, sentence, clause, or phrase of this resolution conflict with the terms of any prior ordinance or resolution, including terms related to fee or charge adjustments, the terms of this ordinance shall control. Project changes before permit issuance Whenever an application that has received assistance from the AHF is changed during development review in a way that decreases the number of affordable units or the level of affordability on which the assistance was based, the amount of the AHF assistance shall be recalculated and the applicant shall be required to pay the difference, if any, between the assistance originally granted and the assistance for which the revised Exhibit A – Resolution No. 2023-10 City of Bainbridge Island Fee Schedule 25 project would have been eligible. This amount shall be paid to the city by the applicant prior to issuance of the permit for which the assistance was received. Project changes after initial permit issuance BIMC 18.21.020.C requires that owners of property on which affordable housing will be built must provide the city with a duly executed covenant running with the land, binding all the assigns, heirs, and successors of the owner of the affected parcels, in a form approved by the city attorney, identifying the affordable units or parcels and acknowledging the owner’s obligations regarding affordability, prior to final approval of any permit. Whenever a project that has received an initial permit utilizing AHF assistance is subsequently changed to decrease the affordable units or the level of affordability on which the AHF assistance was based, the amount of the AHF assistance shall be recalculated and the applicant for any subsequent permit or any amendment of the covenant shall be required to pay the difference, if any, between the assistance originally granted and the assistance for which the revised project would have been eligible.
