ORD 97-06 ZONING FOR WINSLOW MIXED USE TOWN CENTER & HIGH SCHOOL RDORDINANCE NO. 97-06
AN ORDINANCE of the City of Bainbridge Island, Washington,
relating to the Winslow Mixed Use Town Center and High
School Road I and II zoning districts by adding a new Section
18.40.035 and amending Sections 18.06.395, 18.40.020 and
18.40.030 of the Bainbridge Island Municipal Code.
WHEREAS, the City adopted Ordinance 96-08 that established the Mixed Use Town
Center and the High School Road I and II zoning .districts and created development standards
and design guidelines for those zoning districts;
WHEREAS, several errors and omissions have been identified in Ordinance 96-08; and
WHEREAS, the City intends to correct such errors and omissions: now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO
ORDAIN, as follows:
Section 1. Section 18.06.395 of the Bainbridge Island Municipal Code is hereby amended as
follows:
"Floor Area Ratio" is a figure which expresses the total floor area as a multiple of the
lot area. This figure is determined by dividing the floor area of all buildings on a lot
by the lot area. Under building parking is not included in the calculation of floor area
ratio.

Section 2. Section 18.40.020 of the Bainbridge Island Municipal Code is hereby
amended as follows:
18.40.020 Land uses.
No use is allowed except as indicated in the following table:
-Permitted Uses. Uses designated by the letter "P" are permitted on any lot in
the zones indicated, subject to all applicable regulations and the
design guidelines contained in Chapter 18.41.
-Conditional Uses. Uses designated by the letter "C" may be authorized as
conditional uses, in accordance with the provisions of this title and the Design
Guidelines contained in Chapter 18.41.
-Uses not allowed. Uses not allowed in a particular zone or overlay district are
shaded.
Section 3. A new Section 18.40.035, entitled "Structures," is added to of the Bainbridge Island Municipal
Code as follows:
Structure Height is 35 feet, except that taller structures may be allowed with the
issuance of a conditional use permit; provided that (1) view opportunities are
not substantially reduced; (2) sh actares shall not be lx;~mitted in required yards
except as othei wise authorized by this code; (3) each yard requirement shall be
increased one-half foot for every foot above the maximum structure height; (4)
non-commercial, nonparabolic antennae affixed to noncommercial
communication towers that are 50 feet or less in height above grade shall not
require conditional use permits; (5) one flagpole 45 feet or less in height may be
placed on a parcel without requiring a conditional use permit; (6) utility poles
50 feet or less in height shall not require conditional use permits; and (7) utility
structures existing on the effective date of the ordinance codified in this
subsection that are taller than 50 feet shall not be considered nonconforming
structures and may be replaced without a conditional use permit; provided, that
the structure is not larger or taller than the original structure and is not moved
more than 20 feet from the original location.
This section is subject to the provisions of Ordinance 96-49, 1996.
4. Section 18.40.030, entitled, "Development Standards," of the Bainbridge Island Municipal Code is
amended is hereby amended as follows:

For the fu:st 30 feet of the building from the property line of an adjoining lower density
residential zone, the building height shall be the building height of the adjoining lower
density residential zone. Optional building height allowed in the adjoining lower
density residential district through a conditional use permit may be requested for
projects within the mixed use town center and High School Road zones through the site
plan review process.

For properties along Winslow Way, there shall be no driveway from private property to
the street except as approved as a conditional use. Driveways in
existence prior to July 1, 1987, are excepted from this requirement. (Formerly
18.69.070(D).)
