AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, IMPOSING A MORATORIUM ON APPLICATIONS

WHEREAS, RCW 79.09.060(3)(b)(I) and BIMC 16.20.190.D.3 authorize the City to
adopt a moratorium on permits and approvals for forest practice permits which fail to indicate
the intent to convert the timberland to another use and to hold a public hearing on the
moratorium within 60 days of the commencement of the moratorium; and
WHEREAS, the City Council finds that the moratorium imposed by this ordinance is
necessary for the protection of the public health, safety, property or peace; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A moratorium is imposed on the filing and processing of permits and
approvals on tax parcel 112502-2-016, NW quarter, SW quarter, NW quarter, Section 11,
Township 25N, Range 2E, for six years from the date of approval of the forest practices permit
(June 13, 1995).
Section _2. If any provision of this ordinance, or its application to any person, entity or
circumstance, is for any reason held invalid, the remainder of the ordinance, or the application
of the provisions to other persons, entities or circumstances, is not effected.
