ORDINANCE NO. 2024-08
AN ORDINANCE of the City of Bainbridge Island, Washington, amending Titles
2 and 18 of the Bainbridge Island Municipal Code to revise the member
appointment process and the number of members for City Advisory Committees.
WHEREAS, the City Council has previously created various advisory boards,
commissions, committees, and task forces, which are known collectively as “City Advisory
Committees,” to provide recommendations to the Council and perform other functions for the
City; and
WHEREAS, the City Council established an ad hoc subcommittee of three
councilmembers in 2023, which developed recommendations for full Council consideration; and
WHEREAS, on January 23, 2024, the full Council approved the recommendations,
including one recommendation to set the number of positions on all City Advisory Committees
as five to seven positions; and
WHEREAS, the City Council now desires to revise the number of appointed members of
City Advisory Committees; and
WHEREAS, on March 12, 2024, the City Council directed that for certain City Advisory
Committees, the number of appointed members will decrease over time; and
WHEREAS, the City Council acknowledges that to revise the number of appointed
members of City Advisory Committees, a variety of provisions in the Bainbridge Island
Municipal Code must be amended relating to that process.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Section 2.14.020.C.1 and 2.14.020.C.2 of the Bainbridge Island Municipal
Code is hereby amended to read as follows:
2.14.020.C Composition – Appointments – Terms – Residency - Chairpersons
1. The commission shall consist of seven members, and the appointments and
confirmations of those members shall be governed by Chapter 2.01 BIMC. All seven
members of the commission shall be residents of the city. The members shall not be
employees or officers of the city or appointed to another city committee, board or
commission, except for specialized committees or task forces of limited duration. The
commission shall reflect the diverse perspectives, work experiences and backgrounds
represented in the community. Each commissioner shall endeavor to understand and
agree to uphold the city’s adopted comprehensive plan.

2. All members shall serve without compensation for three-year terms, which begin
on July 1st and end on June 30th three years later. Members shall be appointed to a
position number, and the terms are to be staggered, with no more than three positions
expiring in any given year. Members may indicate interest in reappointment for be
reappointed to additional terms, although reappointment is not guaranteed. No member
shall serve more than three consecutive terms on the commission unless the city council
determines that special expertise is required or there are no other qualified applicants.
Section 2. Section 2.14.040.A. of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
A. Membership – Appointment – Term
1. There is created a design review board (board) for the city. The design review
board shall consist of seven members, and the appointments and confirmations of those
members shall be governed by Chapter 2.01 BIMC. Board membership shall include at
least one representative with expertise in the following disciplines and/or groups:
landscape architecture; urban design; public art committee or local artist; developers; at-
large community member; and at least two architects. The members of the design review
board shall not be officers or employees of the city or appointed to another city
committee, board or commission, except for specialized committees or task forces of
limited duration.
2. The members of the board shall serve without compensation. The terms for
appointed members shall be three years, commencing on July 1st and ending on June
30th three years later. Members shall be appointed to a position number, and the terms
are to be staggered, with no more than three positions expiring in any given year. A
member may indicate interest in reappointment for additional terms be reappointed,
although reappointment is not guaranteed, and shall hold office until his or her successor
has been appointed and has qualified. No member shall serve more than three consecutive
terms unless the city council determines that special expertise is required, or there are no
other qualified applicants.
Section 3. Section 2.33.010.A and C of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
A. There is created a utility advisory committee for the city, hereinafter referred to as
“the committee.” The committee shall consist of up to seven voting members, and the
appointments and confirmations of those members shall be governed by Chapter 2.01
BIMC. The members shall not be officers or employees of the city and shall be residents
of the city. The members shall not be appointed to another city committee, board or
commission, except for specialized committees or task forces of limited duration.
Additionally, at least one member of the city council shall serve as an ex officio,
nonvoting member of the committee.

terms, although reappointment is not guaranteed, and shall hold office until his or her
successor has been appointed and has qualified.

Section 4. Section 2.36.010.A and D of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
A. There is created an environmental technical advisory committee for the city,
hereinafter called “the committee.” The committee shall consist of up to seven nine
members, and the appointments and confirmations of those members shall be governed
by Chapter 2.01 BIMC.

D. Members of the committee shall serve for a period of three years, commencing on
July 1st and ending on June 30th three years later. Members shall be appointed to a
position number, and the terms are to be staggered, with no more than three positions
expiring in any given year. A member may be reappointed indicate interest in
reappointment for additional terms, although reappointment is not guaranteed, and shall
hold office until his or her successor has qualified and been appointed. No member shall
serve more than three consecutive terms unless the city council determines that special
expertise is required, or there are no other qualified applicants.
On June 30, 2024 and June 30, 2025, positions 9 and 8 will be eliminated, respectively.
On July 1, 2025, positions shall be re-named as followed: position 7 and 5 shall be
renamed 5 and 7, respectively. The seven position terms shall expire on June 30th and
new terms commence on July 1st three years later, based on the staggering as described.

Section 5. Section 2.37.010.A and D of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
A. There is created a climate change advisory committee for the city, hereinafter
referred to as “the committee.” The committee shall consist of up to seven nine members,
and the appointments and confirmations of those members shall be governed by Chapter
2.01 BIMC.

D. Members of the committee shall serve for a period of three years, commencing on
July 1st and ending on June 30th three years later. Members shall be appointed to a
position number, and the terms are to be staggered, with no more than three positions
expiring in any given year. A member may be reappointed, indicate interest in
reappointment for additional terms, although reappointment is not guaranteed, and shall
hold office until his or her successor has been deemed qualified and been appointed. No
member shall serve more than three consecutive terms unless the city council determines
that special expertise is required, or there are no other qualified applicants.
Members shall serve for three-year terms, except that the existing members of the
Climate Change Advisory Committee shall assume office and become the initial
members of the committee as set forth in this chapter, and the positions on the committee
shall expire as follows: (1) the terms of positions 1, 2, 3 shall expire on June 30, 2027; (2)
the terms of positions 5, 6, and 7 shall expire on June 30, 2025, and position 7 shall be
eliminated; and (3) the terms of positions 4, 8 and 9 shall expire on June 30, 2026 and
position 9 shall be eliminated.
On July 1, 2026, positions shall be re-named as follows: positions 6, 4, and 8 shall be
renamed 4, 6, and 7, respectively. The seven position terms shall expire on June 30th and
new terms commence on July 1st three years later, based on the staggering as described.

Section 6. Section 2.41.010.A. of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
There is created a human services funding advisory task force for the city, hereinafter
called the “task force.” The task force shall consist of up to seven voting members, and
the appointments and confirmations of those members shall be governed by Chapter 2.01
BIMC. Members of the task force shall serve for a single term, to be specified at the time
of appointment, that coincides with the city’s work to review proposals for funding from
community organizations. A member may be reappointed, indicate interest in
reappointment to a separate, subsequent term, although reappointment is not guaranteed.
But no member of the task force shall be appointed to more than three consecutive terms
unless the city council determines that special expertise is required, or there are no other
qualified applicants.
Section 7. Section 2.43.010.A. of the Bainbridge Island Municipal Code is hereby
amended to read as follows:
There is created a cultural funding advisory task force for the city, hereinafter called the
“task force.” The task force shall consist of up to seven voting members, and the
appointments and confirmations of those members shall be governed by Chapter 2.01
BIMC. Members of the task force shall serve for a single term, to be specified at the time
of appointment, that coincides with the city’s work to review proposals for funding from

community organizations. A member may be reappointed indicate interest in
reappointment to a separate, subsequent term, although reappointment is not guaranteed.
But no member of the task force shall be appointed to more than three consecutive terms
unless the city council determines that special expertise is required, or there are no other
qualified applicants.
Section 8. Section 2.72.030.A, C, and D of the Bainbridge Island Municipal Code is
hereby amended to read as follows:
A. The Race Equity Advisory Committee committee shall consist of a maximum of
seven nine members, and the appointments and confirmations of those members shall be
governed by Chapter 2.01 BIMC.

C. Members shall serve for three-year terms, except that the existing members of the
race equity task force shall assume office and become the initial members of the
committee as set forth in this chapter, and the positions on the committee shall expire be
staggered as follows: (1) the terms of positions 1, 2, and 3 shall expire on June 30,
20262023; (2) the terms of positions 4, 5, and 6 shall expire on June 30, 20252022; and
(3) the terms of existing position 7, as well as new positions 8 and 9, shall expire on June
30, 2024.
Following the initial term expirations, future positions shall be appointed as follows: (1)
positions 1, 2, and 3 shall be appointed on July 1, 2026; (2) positions 4 and 5 shall be
appointed and position 6 shall be eliminated on July 1, 2025; and (3) positions 7 and 8
shall be appointed and position 9 shall be eliminated on July 1, 2024.
On July 1, 2025, position 8 shall be re-named position 6, and future positions shall be
appointed as follows: (1) positions 1, 2, and 3 shall be appointed on July 1, 2029; (2)
positions 4 and 5 shall be appointed on 2028; and (3) positions 6 and 7 shall be appointed
on 2027, and for the seven nine positions, the terms shall expire on June 30th and new
terms commence on July 1st and end on June 30th three years later, based on the
staggering as above last described.
D. Upon expiration of their term, a member may indicate interest in reappointment
for additional terms, although reappointment is not guaranteed be reappointed to the
committee for a new term; provided, that no member may serve more than three
consecutive terms unless the city council determines either that their special expertise is
required or there are no other qualified applicants. Upon expiration of their term,
members shall continue to hold office until their successor has been deemed qualified and
been appointed.

Section 9. Section 18.24.020.B.1 and 18.24.020.C. of the Bainbridge Island Municipal
Code is hereby amended to read as follows:
B. Composition of the Commission.
1. The historic preservation commission shall consist of up to seven members, and
the appointments and confirmations of those members shall be governed by
Chapter 2.01 BIMC. The historic preservation commission shall include at least
three members who have experience in identifying, evaluating and protecting
historic resources and who are selected from among the disciplines of history,
architecture, landscape architecture, architectural history, historic preservation,
planning, cultural anthropology, archaeology, biology, geography, cultural
geography, American studies, law, and real estate, referred to in this chapter as
the “professional positions.” An action taken by the historic preservation
commission shall not be invalid due to the temporary vacancy of any or all of the
professional positions, unless the certification agreement between the city and
the State Historic Preservation Office (SHPO) provides otherwise.

C. Term of Historic Preservation Commission Members. Appointments shall be made
for three-year terms, commencing on July 1st and ending on June 30th three years
later. Members shall be appointed to a position number, and the terms are to be
staggered, with no more than three positions expiring in any given year. A member
may indicate interest in reappointment for additional terms, although reappointment is
not guaranteed, be reappointed, and shall hold office until his or her successor has
been appointed and has qualified. No member shall serve more than three consecutive
terms unless the city council determines that special expertise is required, or there are
no other qualified applicants.
Section 10. Severability. Should any section, paragraph, sentence, clause, or phrase of
this ordinance, or its application to any person or circumstance, be declared unconstitutional or
otherwise invalid for any reason, or should any portion of this ordinance be preempted by state
or federal law or regulation, such decision or preemption shall not affect the validity of the
remaining portions of this ordinance or its application to other persons or circumstances.
Section 11. This ordinance shall take effect and be in force on May 1, 2024, which is
more than five (5) days from and after its passage and publication as required by law.
